[HISTORY: Adopted by the Board of Trustees of the Village of Amityville 9-13-2021 by L.L. No. 3-2021. Amendments noted where applicable.]
The Board of Trustees finds that it is in the best interest of the residents of the Village of Amityville to opt out of allowing retail cannabis dispensaries and on-site cannabis consumption establishments within the Village as authorized by § 131 of the Cannabis Law, to protect the health, safety, and welfare of said residents. Given the significance of this decision, and the fact that an opt-out is expressly subject to a permissive referendum, the Board of Trustees further finds that it will exercise its authority pursuant to § 9-908 of the Village Law to direct a permissive referendum on this local law on its own motion.
The Board of Trustees of the Village of Amityville hereby opts-out of licensing and establishing cannabis retail dispensaries and on-site cannabis consumption establishments within the Village of Amityville, and hereby authorizes a referendum on this local law, by the qualified electors of the Village, at a special election to be held in conjunction with the general election on November 2, 2021.
This local law shall not take effect unless and until it has been approved at a referendum conducted in accordance with Article 9 of the Village Law, and filed with the Secretary of State.[1]
