The purpose of this enactment is to prohibit the establishment of retail dispensary licenses and on-site consumption licenses regarding cannabis within the City of Middletown pursuant to § 131 of the Cannabis Law.
Pursuant to § 131 of the Cannabis Law, the City of Middletown hereby requests the Cannabis Control Board of the State of New York to prohibit the establishment of cannabis retail dispensary licenses and usages and to prohibit the establishment of cannabis on-site consumption licenses and usages within the jurisdiction of the City of Middletown.
If the provisions of any article, section, subsection, paragraph,
subdivision or clause of this chapter shall be judged invalid by a
court of competent jurisdiction, such order or judgment shall not
affect or invalidate the remainder of any article, section, subsection,
paragraph, subdivision or clause of this chapter.
This chapter shall be effective upon filing with the office
of the Secretary of State.
