In expansion of the declaration of legislative intent and the statement of community development objectives contained in Article I, §§ 95-2 and 95-3, of this chapter, the specific intent of this district is to:
A. 
Ensure that institutional and recreational facilities are suitably designed and situated to protect the character of adjacent residential properties.
B. 
Ensure that institutional development will take place only when served by adequate public facilities, services and streets.
C. 
Provide appropriate standards for the creation and expansion of institutional and recreational uses in the Borough.
D. 
Maintain and protect the desirable benefits which recreational uses, open space and scenic/natural resources have throughout the community.
A building may be erected, altered or used and a lot may be used or occupied for any of the following purposes and no other when in compliance with applicable use regulations set forth in Article IV, Use Regulations:
A. 
Uses permitted by right. The following uses are permitted by right:
(1) 
Use B-2: single-family detached dwelling.
(2) 
Use C-1: cemetery.
(3) 
Use C-3: day-care facility.
(4) 
Use C-5: emergency services.
(5) 
Use C-6: library, museum, or community center.
(6) 
Use C-7: place of worship.
(7) 
Use E-4: medical office or clinic.
B. 
Uses permitted by conditional use. The following are only permitted upon the issuance of conditional use approval by Borough Council:
(1) 
Use D-10: recreation, outdoor.
(2) 
Use C-4: educational institution.
(3) 
Use C-8: residential care facility.
C. 
Accessory uses permitted by right. The following accessory uses are only permitted when subordinate and customarily incidental to any of the above permitted uses and upon the issuance of a zoning permit:
(1) 
Use A-1: residential accessory structures.
(2) 
Use A-2: nonresidential accessory structures.
(3) 
Use A-4: commercial vehicle parking.
(4) 
Use A-7: fences and walls.
(5) 
Use A-8: home-based business, no-impact.
(6) 
Use A-11: recreational vehicles.
(7) 
Use A-12: refuse collection facilities.
(8) 
Use A-13: renewable energy systems.
(9) 
Use A-14: satellite dishes and antennas.
(10) 
Use A-15: swimming pool, residential.
(11) 
Use A-16: non-tower wireless telecommunications facility, in compliance with § 95-164.
D. 
Accessory uses permitted by special exception. The following accessory uses are permitted when they are subordinate and customarily incidental to any of the above permitted uses and upon the issuance of special exception approval by the Zoning Hearing Board:
(1) 
Use A-3: bed-and-breakfast home.
(2) 
Use A-6: family child-care home.
The following dimensional standards shall apply to all uses in the IN District:

A. 
In addition to the requirements of this article and chapter, the following standards shall apply to all uses requiring the issuance of a conditional use permit in the IN District:
(1)

(2) 
Building spacing. When multiple buildings are proposed, such buildings shall be separated by the greater value of the height of the taller of the two adjacent buildings or 25 feet.
(3) 
Landscape buffer required. A landscape buffer 15 feet in width shall be provided along any property line abutting a residential district or property. The landscape buffer shall meet the requirements of Chapter 85, Subdivision and Land Development.
(4) 
Fencing. Fencing surrounding outdoor recreation areas, such as sports courts, is required and may be as high as 12 feet provided that the fence is set back a minimum of 10 feet from all property lines.
(5) 
Transportation impact study. A transportation impact study shall be required as part of the evaluation of conditional use applications. Transportation impact studies shall, when required, be prepared pursuant to § 85-122, Transportation impact study, of the Subdivision and Land Development Ordinance.
A. 
Plans for any IN District institutional use shall be submitted to the Planning Commission prior to the issuance of any zoning permit and shall meet the requirements as specified in the East Greenville Subdivision and Land Development Ordinance[1] and, in addition, shall include the following:
(1) 
A plot plan of the lot showing the location of all present and proposed buildings, drives, parking lots and other constructional features on the lot and all buildings, streets, alleys, highways, streams and other topographical features of the lot.
(2) 
A description of the institutional operation in sufficient detail to indicate the effects of these operations in producing traffic congestion, noise, glare or other safety hazards.
(3) 
Engineering and architectural plans for the treatment and disposal of sewage.
(4) 
Any other pertinent data that the Planning Commission may require.

B. 
The Planning Commission shall review all plans submitted to it and shall submit these plans with recommendations thereon to the Borough Council for final approval.
C. 
The Borough Council shall have the power of approval or disapproval of these plans and its Secretary shall notify, in writing, the Zoning Officer of the Council's final decision and any special conditions agreed upon.
