This article shall be known and may be cited as the "School Board Property and Grounds Trespass and Prohibited Activities Ordinance."
This article is designed to enable Borough Police Officers to patrol and enter upon school property or grounds pursuant to a grant of authority from the East Rutherford Board of Education for the purposes of preventing the unauthorized presence of persons during certain time periods and to prevent certain listed activities and conduct at any time, and to arrest and fine those persons who engage in such prohibited activities. This article is necessary to maintain the safety and welfare of persons who are authorized to be on or in School Board property and facilities, as well as to protect School Board property.
A. 
Any person who is present on the property or grounds owned by the East Rutherford Board of Education between the hours set forth below without the authority of the Board of Education shall be considered a trespasser and shall be in violation of this article.
B. 
Time periods. Presence on School Board property without authorization is hereby prohibited during the following time periods:
(1) 
Daylight savings time: 8:00 p.m. to 7:00 a.m.
(2) 
Non-daylight savings time: 6:00 p.m. to 7:00 a.m.
A. 
Activities prohibited on all School Board property. Unless authorized by the East Rutherford Board of Education, the following activities are prohibited at all times on all property owned by the East Rutherford Board of Education.
(1) 
Loitering.
(2) 
Walking of dogs.
(3) 
Loud music.
(4) 
Alcoholic beverages.
(5) 
Golfing.
(6) 
Dumping of refuse.
(7) 
Defacing, damaging, or destroying School Board property.
(8) 
Hardball playing.
(9) 
Playing on dumpsters.
(10) 
Parking or driving of unauthorized vehicles on School Board property.
(11) 
Skateboarding, roller blading or roller skating.
(12) 
Any type of bicycling, including scooters and ebikes.
B. 
Violations. Any person taking part in any of the activities prohibited under Subsection A shall be in violation of this article.
Any person who violates this article shall be subject to a fine of up to $250 for the first offense and a fine of $500 for any subsequent offense.
