Unless otherwise expressly stated, the following terms shall, for the purpose of this chapter, have the meanings herein indicated:
ACCESSORY
See "use, accessory" definition below.
ACRE
An area containing 43,560 square feet.
ACRE, GROSS
The total acreage of a parcel or parcels of land proposed for subdivision and/or development, as determined by a certified survey or deed plotting prepared by a licensed professional surveyor.
ALTERATIONS
Any change, rearrangement or addition to a structure other than repairs; any modification in construction whether by increasing in height, extending on a side, in repositioning or relocating a structure or portion thereof.
ALTERATIONS, STRUCTURAL
Any change in the supporting members of a building, such as bearing walls, columns, beams or girders.
AREA
The measurement of the horizontal surface of a space calculated in acres or square feet.
AREA, BUILDING
The total of areas taken on a horizontal plane at the main grade level of principal buildings and all accessory buildings, exclusive of uncovered porches, steps and terraces.
AREA, FLOOR
The sum of the gross horizontal areas of the several floors of a building or buildings on a lot measured from the exterior faces of exterior walls or from the center line of party walls separating two buildings, excluding cellar and basement areas used only for storage or for the operation and maintenance of the building. Note: Also see "floor area ratio" definition below.
AREA, LIVABLE FLOOR
All spaces within the exterior walls of a dwelling unit exclusive of garages, breezeways, unheated porches, heater rooms and basements having a window area of less than 20% of the square foot area of the room. Usable floor area shall include all spaces not otherwise excluded above, such as principal rooms such a bedrooms, kitchens, and living rooms, utility rooms, bathrooms, all closets and hallways opening directly into any rooms within the dwelling unit and all attic space having a clear height of six feet from finished floor level to ceiling level over 50% of the area of such attic space.
AREA, NET SITE
The total area within the property lines, excluding external streets.
ART GALLERY
A retail use engaged in the sale, loan or display of art books, paintings, sculpture, or other works of art. This use does not include libraries or museums.
ART STUDIO
A studio or other space used by an artist for the development, display, and sale of art or the instruction in a personal artistic skill such as fine arts, crafts, dance and music. Said use shall not involve food preparation, mechanical equipment such as kilns, commercial-scale ovens, milling machines and similar equipment.
BANK
A bank or similar financial institution is licensed to receive monetary deposits and make loans. Banks may also provide financial services, such as wealth management, currency exchange and safe deposit boxes. A bank may include a drive-through facility and ATM machine for the conduct of business.
BARN
A building used, or formerly used, for storage of agricultural products, equipment or livestock.
BARRIER
A fence, wall, building wall or combination thereof.
BASEMENT
That space of a building that is partly below natural grade, which can be no greater than 10 feet measured from floor to ceiling. Basements that are greater than 50% above natural grade shall be deemed a story, whether habitable or not.
BED-AND-BREAKFAST
An owner-occupied residence involving the rental of up to four bedrooms as transient accommodations for no more than a 14-day length of stay, with breakfast served to guests but with no full-service restaurant facility and with no more than one nonresident employee.
BEDROOM
A room in a dwelling unit which is used, or could be used, primarily for sleeping.
BILLBOARD
A sign which directs attention to a business, commodity, service, entertainment or attraction sold, offered or existing elsewhere than upon the same lot where such sign is displayed or only incidentally upon such lot.
BUILDING
Any structure having a roof supported by columns or by walls and intended for shelter, housing, protection or enclosure of persons, animals or property. Depending upon its applicability, the use herein of "building" shall include the term "structure."
BUILDING FACE
The outer surface of a building, which is visible, in whole or in part, from any private or public street or public parking area.
BUILDING, ACCESSORY
A detached subordinate building on a lot or parcel of land, the use of which is customarily incidental to that of the main or principal building on the same lot or parcel.
BUILDING, DETACHED
A building surrounded by open space on the same lot or parcel of land.
BUILDING, MAIN OR PRINCIPAL
A building in which the main or principal use of the lot on which it is situated is conducted.
BULLETIN BOARD
An on-premises sign which identifies a charitable, educational or religious institution or organization and which contains the name of the institution or organization, the names of associated individuals and general announcements of events or activities occurring at the institution or organization or similar messages.
BUSINESS OFFICE
A place or establishment used for the organizational or administrative aspects of a trade or used in the conduct of a business and not involving the manufacture, storage, display or direct retail sale of goods. This may include, but is not limited to, offices of salesmen, sales representatives, insurance brokers, real estate brokers and persons with similar occupations.
CELLAR
That space of a building that is completely below natural grade, which can be no greater than 10 feet measured from floor to ceiling.
CEMETERY
Land and buildings, whether privately or publicly owned or operated, used for the burial of deceased human beings, by cremation or in a grave, mausoleum, vault, columbarium or other receptacle. Such term shall also include land and accessory buildings, including, but not limited to, ground maintenance-related storage facilities, tools and equipment. A crematory is not deemed an accessory use or building to a cemetery.
CLUB AND FRATERNAL LODGES
An organization catering exclusively to members and their guests, including premises and buildings for recreational, social or athletic purposes, which are not conducted primarily for gain, provided that no vending stands, merchandising or commercial activities are conducted except as required generally for the membership and purposes of such club.
CLUSTER DEVELOPMENT
A subdivision plat or plats, approved pursuant to this article, in which the applicable zoning local law is modified to provide an alternative permitted method for the layout, configuration and design of lots, buildings and structures, roads, utility lines and other infrastructure, parks, and landscaping in order to preserve the natural and scenic qualities of open lands. Cluster development enables and encourages flexibility of design and development to promote the most appropriate use of land, to facilitate the adequate and economical provision of streets and utilities and to preserve the natural and scenic qualities of open lands. Approval procedures are set forth in § 119-15.
COMMERCIAL AGRICULTURAL OPERATION
Land and on-premises buildings, equipment, uses, activities, and practices which contribute to the production, preparation, and sale of crops, livestock and livestock products as a commercial enterprise. Horse-boarding operations are deemed agricultural uses. The term "agriculture" specifically excludes slaughterhouses and concentrated animal feeding operations (e.g., factory farms for high density animal production). Timber operations are not permitted as an agricultural use. The production of compost, soil or other biomass products is not an agricultural use but is allowed solely where it is accessory to and a product of the operation of an agricultural use. The clearing of land for an agricultural use is permissible, provided an applicant has first obtained a clearing, filling and grading permit specifically for said purposes and any other permits and approvals from applicable agencies.
CONDOMINIUM
A mode of ownership wherein each dwelling unit may be owned in fee simple individually and separately from all others, but where all such owners have an indivisible interest in the common areas. Thus, they share ownership and attendant responsibilities for the provision, maintenance and/or repair of common internal facilities, utilities, services, buildings, land, landscaping and other outdoor facilities.
CONVERSION RESIDENTIAL
A change of use or occupancy of a dwelling by alteration or by other reorganization as to increase the number of families or dwelling units in a structure.
CONVERSION, BARN
A change of use of a structure previously used as a barn by alteration to commercial or residential use as permitted by the zoning district in which it is situated and by all applicable governmental codes and legislation.
CRAFT BREWERY/WINERY/DISTILLERY
An establishment which produces on the premises beer, wine, cider, vinous beverages, spirits or edible goods for off- and/or on-site consumption in accordance with New York State Liquor Authority, Department of Health and other applicable agency regulations. Such an establishment may include a public component, such as a tasting room, restaurant and/or a retail establishment. Production shall be limited to 75,000 barrels per year for breweries, 75,000 gallons per year for distilleries and 250,000 gallons per year for wineries.
CURB LEVEL
The established elevation of the street grade at the point that is opposite the center of the wall nearest to and facing the street line.
DECK
Construction attached to a building open to the sky with floor materials built at an elevation above natural grade. Decks require issuance of a building permit prior to construction.
DRIVE-THROUGH AND DRIVE-UP ESTABLISHMENTS
An establishment which, by design, physical facilities, service or by packaging procedures, encourages and permits customers to receive services and obtain goods while remaining in their vehicles or by walking to an exterior service area.
DWELLING UNIT
A building designed or used as living quarters for one family. The existence in design or otherwise of more than one room in a dwelling designed or used for cooking and food preparation and designed to contain or containing cooking facilities and food storage and preparation facilities, commonly known as a "kitchen," shall be prima facie evidence that the dwelling is not designed for or used by one family. The existence in design of a floor and room layout for a second story substantially similar in design to the floor layout of the ground floor of the same dwelling, which second story can be isolated from the ground floor by a single door or partition, shall likewise be prima facie evidence that the dwelling is not designed for use by one family. A house trailer, boardinghouse or rooming house, convalescent home, dormitory, fraternity or sorority house, hotel, inn, lodging, nursing or other similar homes or other similar structures shall not be deemed to constitute a dwelling unit.
DWELLING, ATTACHED
A one-family dwelling having one or two side-party walls constructed on common interior lot lines, situated upon a separate lot, and having private entrances; each contiguous dwelling shall have an undivided 1/2 interest in each party wall.
DWELLING, MULTIPLE OR MULTIFAMILY
A building or portion thereof containing more than two dwelling units, on one or more plots, but which may have joint services or joint facilities or both. The term "multifamily dwelling" shall also include apartments or apartments by conversion.
DWELLING, ONE-FAMILY DETACHED
A detached building on a single lot containing one dwelling unit only. Also referred to as a "single family dwelling"
DWELLING, TWO-FAMILY
A detached building containing two dwelling units only in which the units are separated by vertical or horizontal partitions and not by a party wall.
EATING AND DRINKING PLACES
Any commercial use where food and beverages are sold primarily for on-premises consumption to patrons seated at tables and where food is served at the table. A restaurant, bar, or tavern is considered an eating and drinking establishment.
FAMILY
One or more persons living as a single housekeeping unit and maintaining a common household, whether or not related by blood, marriage or adoption, and, in addition, any domestic servants or gratuitous guests.
FAST-FOOD RESTAURANT
An establishment whose principal business is the sale of pre-prepared or rapidly prepared food directly to the customer in a ready-to consume state for consumption either within the restaurant building or off the premises. (See also "drive-through establishment," if applicable.)
FLOOR AREA
See "area, floor" definition above.
FLOOR AREA RATIO (FAR)
The gross aggregate floor area, in square feet, of all buildings on a lot divided by the gross square foot area of such lot.
FLOOR AREA, LIVABLE
See "area, livable floor" definition above.
FRONTAGE
The extent of a building or of land along a street.
FUNERAL PARLOR
A building used for the preparation of the deceased for burial and the display of the deceased and rituals connected therewith before burial or cremation.
GARAGE
A building or part thereof used for the storage or parking of one or more motor vehicles.
GARAGE, PRIVATE
An accessory building or part of a main building used for storage and having a capacity of no more than the number and type of motor vehicles permitted in this chapter, and which is not operated for commercial purposes.
GARDEN CENTER
A retail use where gardening supplies, such as seeds, plants, fertilizer, and tools are sold.
GARDEN HOUSE
An accessory structure on a residential site, such as a gazebo, used for outdoor entertaining or garden viewing or private greenhouse.
GASOLINE/PETROLEUM PRODUCTS SALES
A building or lot or part thereof supplying and selling gasoline or other equivalent fuel for motor vehicles at retail direct from pumps and storage tanks which also may include accessory facilities for rendering services such as lubrication and washing.
GRADE
The ground elevation established for the purpose of regulating the number of stories and the height of the building. The building grade shall be the level ground adjacent to the walls of the building if the finished grade is level. If the ground is not entirely level, the grade shall be determined by averaging the elevation of the grade for each side of the building.
GRADE NATURAL
The grade unaffected by construction techniques such as fill, landscaping, or berming. The natural grade of a parcel shall be determined by the Building Inspector prior to the issuance of any building permit, clearing, filling and grading permit or land disturbance permit.
HABITABLE ROOM
A space in a building for living, sleeping, eating or cooking. Bathrooms, toilet rooms, closets, halls, storage or utility spaces and similar areas are not considered.
HEIGHT, BUILDING
The vertical distance measured from the average elevation of the finished grade at the front of the building to the highest point of the roof for flat and mansard roofs and to the mean height between eaves and ridge for all other types of roofs. The height limitations specified in each district shall not apply to the following, unless specifically stated in this chapter: chimney, spires, belfries, cupolas, and rooftop appurtenances such as antennas, elevator penthouses, water towers or mechanical equipment.
HELIPAD
A takeoff and landing area for helicopters, usually without commercial facilities.
HOME OCCUPATION, CUSTOMARY
A legal business activity operated for financial gain in, or directed from, a dwelling unit operated by one or more occupants of such dwelling unit. The business activity must be clearly an accessory use and must not change the residential character of the premises. Examples of home-based businesses include physicians, doctors, dentists, lawyers, architects, engineers, designers, music teachers, hairdressers, teachers, licensed real estate and/or insurance brokers, artist workshop and studio, and other similar professional uses.
HOSPITAL
A hospital is a facility established pursuant to Article 28 of the New York State Public Health Law engaged in providing medical and/or surgical services primarily to inpatients by or under the supervision of a physician on a twenty-four-hour basis with provisions for admission or treatment of persons in need of emergency care and with an organized medical staff and nursing service, including facilities providing services relating to particular diseases, injuries, or conditions. The term '"hospital" shall include such other and related facilities which may or may not be established pursuant to Article 28 of the New York State Public Health Law, including, but not limited to, laboratories, out-patient, diagnostic and treatment facilities and pharmacy, together with the appropriate office and related support facilities. The term "general hospital" shall not include a residential health care facility, public health center, diagnostic center, treatment center, outpatient lodge, dispensary and laboratory or central service facility serving more than one institution.
HOTEL
A facility offering rooms for lodging accommodations for compensation to the general public and wherein all rooms are connected to interior hallways and thereby to interior elevators, lobbies and/or stairways, through which access to the exterior is gained. Motels are not included in this definition. Conference space, a restaurant, and recreational amenities are allowed accessory to a hotel.
HOUSE TRAILER
See "mobile home" definition below.
INDUSTRIAL PARK
A planned development area designed for the construction of manufacturing, research, warehouse, distribution, office and other related uses and facilities.
JUNKYARD
Any place where old or secondhand metal, bottles, glassware, hardware, paper, lumber, plumbing fixtures, dismantled or inoperable automobiles, dismantled or inoperable machinery or any other thing which is no longer used or usable for its intended purpose but which has value because of the parts or materials it contains is collected or stored, regardless of whether the place is covered or uncovered and regardless of whether it is located within any building or structure.
KENNEL
Any place at which there are kept four or more dogs more than four months of age or any number of dogs that are kept for the primary purpose of sale or for the boarding, care or breeding of dogs or other household pets.
LAUNDROMAT/DRY CLEANER
A commercial use for pick-up and delivery only of dry-cleaned garments or laundry. Tailoring services are allowed accessory to a laundry or dry-cleaning establishment.
LOT
A parcel of land, not necessarily coincident with a lot or lots shown on a map of record, which is or is to be occupied by a building and any of its accessory buildings, or by a group of buildings, together with such open spaces as are required under the provisions of this chapter, having not less than the minimum area and width required by the regulations of the district in which such land is situated and having its principal frontage on a street or on such other means of access as may be determined in accordance with the provisions of state law to be adequate as a condition of the issuance of a building permit for a building on such land.
LOT COVERAGE
The percentage of the area of a lot covered by buildings, indoor and outdoor parking areas, accessory structures and any impervious materials, including natural impervious areas.
LOT DEPTH
The distance from the street line of a lot to the rear lot line.
LOT LINE
The property boundaries of a lot.
LOT LINE, FRONT
A lot line which separates a lot from a street or other means of access.
LOT LINE, REAR
The lot line generally opposite and parallel to the front lot line. The lot line generally opposite the street line. If the rear lot line is less than 10 feet in length or if the lot comes to a point in the rear, the "rear lot line" shall be deemed to be a line parallel to the front lot line not less than 10 feet long lying farthest from the front line or the measured distance of the required rear yard setback.
LOT WIDTH
The dimension measured from side lot line to side lot line at both the required minimum front and rear yard setbacks and perpendicular to the side lot lines. In cases where side lot lines are not parallel, the perpendicular shall be measured from the lot depth midpoint line.
LOT, AREA OF
The total area included within lot lines.
LOT, CORNER
A lot which has an interior angle of no more than 135° at the intersection of two street lines. A lot abutting a curved street shall be considered a "corner lot" if the tangents to the curve at the points of intersection of the side lot lines with the street lines intersect at an interior angle of less than 135°.
LUMBER, BUILDING, AND LANDSCAPE MATERIAL SALES
The sale of building and landscape materials, including the sale of trees, shrubs, or plants. Sale and storage of garden supplies, including hand tools, mulch, soil, decorative rock, pavers, and similar non-vegetative materials shall be allowed only where clearly incidental to the principal use and said accessory materials shall not occupy more than 25% of the lot area. The on-site materials aggregate processing of organic or inorganic materials including rock crushing, mulching, or soil screening is not permitted in conjunction with this use
MANUFACTURING
Any process whereby the nature, size or shape of articles or raw materials is changed or where articles are assembled or packaged in quantity.
MATERIALS PROCESSING
Any use involving the processing of stone, soil, wood, metal, or other raw materials through crushing, sifting, sorting, material screening, splitting, blasting or other means.
MEMBERSHIP CLUB
Premises used by a not-for-profit organization with annual membership dues catering exclusively to members and their guests for social, recreational, athletic, professional, cultural or similar purposes. The members of the organization shall have a financial interest in, and method of control of, the assets and management of the "membership club."
MOBILE HOME
A transportable one-family dwelling equipped for year-round occupancy and containing the same water supply, waste disposal, heating and electrical conveniences as immobile housing and which must conform to the New York State Building Code pertaining to such structures. The term "mobile home" shall include vehicles mounted on temporary or permanent foundations, but shall not include a camping trailer, travel trailer or office trailer. Any transportable dwelling in excess of 40 feet shall be deemed to be a "mobile home."
MOTEL
A facility offering rooms for lodging accommodations for compensation to the general public and which access to the room is gained through exterior stairs or parking areas.
MOTOR VEHICLE REPAIR SHOP
A building or portion of a building arranged, intended or designed to be used for making repairs to motor vehicles, their mechanical systems and their body structure, including painting.
MOTOR VEHICLE SALES
A building and/or area arranged, intended or designed to be used for the rental, lease, sale and/or resale of motor vehicles, new or used.
MOTOR VEHICLE SERVICE
A facility primarily engaged in the retail sale of motor vehicle fuels and fluids and/or in the routine maintenance or servicing of motor vehicles, including activities such as engine diagnostics, tune-ups, or changing of fluids, but not including the painting thereof by any means.
NEWSPAPER PRINTING
A facility involved in the production of books, newspapers, or other printed material.
NONCONFORMING BUILDING
An existing building which contains a use permitted in the district in which it is located but which does not comply with one or more district regulations for lot area, width or depth; front, side or rear yard; maximum height or lot coverage; or off-street parking or loading area.
NONCONFORMING USE
Use of a building, structure or land that does not conform to the permitted or special uses prescribed for the district in which it is situated, which existed and was not prohibited by the Village's zoning chapter at the time the use was established.
NONPROFIT ORGANIZATION
An organization that has been designated by all appropriate applicable state and federal agencies as a nonprofit agency or organization and has possession of such certification. A not-for-profit organization is also considered nonprofit organization.
NURSERY
A place where trees, shrubs, vines and/or flower and vegetable plants are grown and/or are offered for sale, to be transplanted onto the lands of the purchaser by the purchaser or by a landscape contractor.
NURSING HOME
A facility licensed by the State of New York to provide full-time health care under medical supervision to individuals who are unable to fully care for themselves, but not including facilities for surgical care or institutions dedicated to the care and treatment of mental illness, alcoholism, or narcotics addiction.
PARTY WALL
The wall created on the boundary of the two properties and which serves as a common structure between the two premises owned by different parties.
PATIO
A flat, leveled structure attached to a building by steps, or other construction, and having a base floor area at or below natural grade and open to the sky. A patio structure below or at grade is not deemed to be a deck or porch and shall not require a building permit. New step areas to patios, decks, porches, breezeways, etc., will require a building permit. Any other patio or similar structure constructed above natural grade also requires a building permit.
PERSONAL SERVICES
A commercial use in which the product offered is the work or action performed, as in shoe repair shop, beauty shop, barber shop, and similar uses.
PET
A domesticated animal kept by a household for companionship and enjoyment such as cats, dogs, birds, reptiles, aquarium fish, and hamsters, which are normally and conventionally boarded in a residential dwelling or on a residential lot.
PLACE OF WORSHIP
A structure or place in which worship, ceremonies, rituals and education pertaining to a particular system of belief are held. Places of worship may include clergy offices, offices of the place of worship, meeting rooms to be utilized for various activities and community services offered or sponsored by the place of worship, social halls (except that said social hall may not be utilized as a place of business for a commercial caterer), clergy or caretaker residence, day care and recreation areas.
PLANNED ADULT COMMUNITY
A residential development which is designed with amenities and features to meet the needs of a specific age group, typically restricted for occupancy to those over the age of 55 years and their household members.
PRINCIPAL BUILDING
A building in which is conducted the main or principal use of the lot on which said building is located.
PROFESSIONAL OFFICE
An office devoted to a professional service occupation, in which knowledge in some department of science or learning is applied to the affairs of others, either advising or guiding them, or otherwise serving their interest or welfare through the practice of a profession founded on such knowledge. A professional office may include but not be limited to the office of an accountant, architect, consultant, engineer, or attorney.
PROFESSIONAL OFFICE, CUSTOMARY ACCESSORY
A use or structure that is subordinate to the principal use on the same lot, serving a purpose typically incidental and well established to the principal use, and characteristic of uses which can be categorized as a "professional office" (see above). In order for a use or structure to be deemed a customary accessory use, it must be: a) subordinate to the principal use on the same lot, b) serving a purpose that is typically incidental and well established to the principal use, and c) unity of ownership between the principal and accessory uses. In no case shall such accessory use dominate in land area, extent, surface area, gross floor area or purpose to the principal use but be minor in its association with the principal/primary use. Accessory parking only is permitted to exceed in size, the size of the principal use, and be deemed accessory.
PUBLIC SEWER AND PUBLIC WATER
Sewage disposal and water supply systems approved by the Village Board for municipal operation.
PUBLIC UTILITY FACILITIES
Facilities belonging to and operated by persons, firms or corporations supplying gas, electricity, water, power, transportation, television, cable or telephone service to the general public, including wireless telecommunications services facilities which are regulated separately under this chapter. This definition does not include solar energy systems or battery storage facilities which are regulated elsewhere in the Code.
RETAIL SALES OF ITEMS MANUFACTURED ON PREMISES
A business premises used for the making of clothing, millinery, shoes or other personal articles to individual order and measure for sale at retail on the premises only, not including the manufacture of ready-to-wear or standardized products.
RETAIL STORES
A commercial use where merchandise is sold directly to the general public for personal or household use or consumption rather than for resale, including, but not limited to, a florist, hardware store, pharmacy, convenience store, stationary store, bookstore, clothing store, shoe store, and jewelry store. The storage of merchandise on the premises shall be clearly incidental and accessory to the space dedicated to retail sale of products.
RIGHT-OF-WAY
The area, as designated by the agency responsible for a specific transportation purpose, that is to remain free from any structures or encroachments.
SCHOOL
Any educational institution conducting a regularly scheduled curriculum and operated either privately or by a public school district in accordance with the Education Law of the State of New York and chartered by the New York State Board of Regents. For purposes of this zoning chapter, private and public schools shall include schools serving grades kindergarten through 12th grade.
SELF-SERVICE STORAGE FACILITY
A facility containing separate, individually feasible or rentable storage spaces of varying sizes for business or household goods.
SETBACK
A required minimum distance measured perpendicular from a front, side, or rear property line beyond which a building or principal use may be located.
SIGN
Any permanent display of lettering, numbers, logos, designs, colors, lights, or illumination visible to the public from outside of a building or from a public right-of-way which conveys a message to the public or intends to advertise, direct, invite, announce or draw attention, directly or indirectly, to a use conducted, events, goods, products, services, or facilities available as regulated in § 119-18 of this zoning chapter.
SIGN DIRECTORY
A listing of two or more business enterprises, consisting of a matrix and sign components.
SIGN STRUCTURE
The supports, uprights, bracing, framing, mountings and framework for a sign. In the case of a sign structure consisting of two or more sides in which the angle formed between any two sides, or the projections thereof exceeds 30°, each side will be considered a separate sign structure.
SIGN SURFACE AREA
The entire area within a single, continuous perimeter enclosing all elements that form an integral part of the sign. The structure supporting the sign shall be excluded unless the structure is designed in such a manner as to form an integral background for the display. One side of a double-faced sign shall be used to calculate the total surface or area of such a sign.
SIGN, ADDRESS OR ANNOUNCEMENT
A sign stating only the name and/or address of the occupant(s) of the property.
SIGN, AREA OF
The entire face of display surface of one side of a sign, including the advertising surface of any framing, trim or molding.
SIGN, AWNING
Any visual message incorporated into an awning attached to a building.
SIGN, COPY-CHANGE
A sign on which the visual message may be periodically changed.
SIGN, DIGITAL CHANGE BOARD
A sign capable of displaying words, symbols, figures or images that can be electronically changed by remote or automatic means and are distinct from conventional "manual-change copy" signs that do not change their message except through physical replacement of letters or words on the sign.
SIGN, DIRECTIONAL
A sign limited to providing information as to the location of a business, activity or event or a sign on which is located a simple traffic directive directed only to persons on the lot, such as a "no parking," "loading in rear," "one-way" or "office this way" sign.
SIGN, FLASHING
Any sign that exhibits changing natural or artificial light or color effects by any means.
SIGN, FREESTANDING
Any sign not attached to or part of any building but separate and permanently affixed by any other means in or upon the ground. Included are pole signs and pylon signs constructed of wood, masonry materials or any other material.
SIGN, ICONIC
A sign composed of a symbol, such as, but not limited to, a barber pole, eyeglasses or mortar and pestle.
SIGN, ILLUMINATED
Any sign illuminated by electricity, gas or other artificial light, either from the interior or exterior of the sign, and which includes reflective and phosphorescent light.
SIGN, INTERIOR
Any sign that is affixed to or painted on the interior of a window, or any sign located within three feet of the inside face of the window, which sign is designed to be visible from the exterior of the window.
SIGN, OFF-PREMISES
A sign, including a billboard, which directs attention to a business, product, service or entertainment conducted, sold or offered at a location other than the premises on which the sign is located.
SIGN, PORTABLE
A sign, whether on its own trailer, wheels or otherwise, designed to be movable and not structurally or permanently attached to the ground, a building, a structure or another sign.
SIGN, PROJECTING
A sign which is attached to a building, wall or structure and which extends horizontally more than nine inches from the plane of such wall or structure or a sign which is perpendicular to the face of such wall or structure.
SIGN, REAL ESTATE
A sign which advertises the availability of land, buildings or spaces within buildings as being for sale or rent.
SIGN, REPRESENTATIONAL
A three-dimensional sign built to physically represent the object advertised.
SIGN, ROOF
A sign that is erected, constructed or maintained on, above or as part of the roof of any building.
SIGN, SANDWICH BOARD
Any sign consisting generally of two flat surfaces secured to or leaning against each other at the top and placed on the ground in front of the business premises.
SIGN, TEMPORARY
A sign related to a single activity or event having duration of 30 days or less.
SIGN, WALL
A sign which is painted on or attached to the outside wall of a building with the face of the sign parallel to such wall and not extending more than nine inches from the face of such wall.
SIGN, WINDOW
A sign visible from a sidewalk, street or other public place, painted or affixed on glass or other window material, or located inside in such a manner to be viewed from outside, but not to include graphics in connection with customary window display of goods or products.
SILO
An agricultural building used, or formerly used, for storage of grain and similar products.
STORY
The part of any building, exclusive of cellars or basements, comprised between the upper surface of a finished floor and the upper surface of the finished floor or roof next above.
STORY, HALF
Any space partially within the roof framing where the clear height of not more than 50% of such space between the top of the floor beams and the structural ceiling level is seven feet six inches or more.
STREET
A road shown on the official map of the Village of Florida, or an existing Village, county, state highway or street shown on an approved subdivision plat, or a street shown on a plat filed with the County Clerk prior to the Planning Board's authorization to review a subdivision.
STREET LINE
The dividing line between a lot and the center of street or measured 25 from the lot.
STRUCTURAL ALTERATION
See "alteration, structural" definition above.
STRUCTURE
Anything constructed or erected, the use of which requires location on, in or under the ground or attached to something located on the ground, such as, but not limited to, buildings, sheds, decks, signs, fences, walls, radio and communications towers.
SWIMMING POOL
Any structure intended for swimming or recreational bathing that contains water over 24 inches (610 mm) deep. This includes in-ground, aboveground and on-ground swimming pools, hot tubs and spas.
TELECOMMUNICATIONS (CELLULAR) TOWERS
Any freestanding structure including lattice structures or framework and freestanding self-supported vertical pole (commonly known as monopole) on which any equipment is located in connection with the provision of wireless communications services.
TOWNHOUSE or ROW HOUSE
A one-family dwelling unit extending from basement to roof with a party wall separating it from one or more adjoining dwelling units.
TRUCKING TERMINAL
A facility for the temporary storage of finished products in a warehouse or other specialized building, with or without refrigeration or air conditioning, which is stocked with products to be redistributed to retailers or wholesalers, by vehicle, van, or truck.
USE
The specific purpose for which land or a building is designed, arranged, intended or for which it is or may be occupied or maintained.
USE, ACCESSORY
A use customarily incidental and subordinate to the main use on a lot, whether such accessory use is conducted in a principal or accessory building. Any use which is accessory to a special permit use shall also be a special permit use. Any use which is accessory to a principal permitted use shall also be a permitted use, if any and all conditions specified for such accessory use can be satisfied.
USE, CONDITIONAL
A use which is deemed desirable for the public welfare within a given district or districts, but which is potentially incompatible with permitted and accessory uses provided therein and, therefore, certain conditions are required to be met before the use is permitted. A special permit use shall be subject to authorization and plan approval by the Planning Board, as regulated for the respective use in this chapter.
USE, PRINCIPAL
The main use of the lot, building or structure.
USE, PROHIBITED
A use of a building or structure, lot or land, or part thereof, which is not listed as a permitted, conditional or accessory use.
VETERINARY CLINIC
An establishment where animals, typically pets, are provided medical care by a NYS licensed veterinarian and where the boarding of animals is short-term and clearly incidental to its medical care.
VILLAGE-OWNED PUBLIC USE
Facilities owned or operated by the Village and not subject to the standards of this chapter, including, but not limited to, reservoirs; water supply reservations; parks and open space; playgrounds; recreational facilities; community centers; libraries; firehouses; police stations; government offices; government garages; and public parking areas.
WAREHOUSE/STORAGE FACILITIES
A use engaged principally in the long-term indoor storage of materials and/or manufactured products, supplies and equipment, excluding bulk storage of materials that are flammable or explosive or that present hazardous conditions. Nothing herein shall be construed to permit retail sale of merchandise to the general public or by membership.
YARD, FRONT
An open space on the same lot with a building between the nearest front line of the building and the street line extending across the full width of the lot. The front yard setback line is defined for each district in this zoning chapter and refers to the minimum distance between the street line and the main building or any projections thereof other than the projections of uncovered steps or uncovered porches and adjacent step areas regardless of area.
YARD, REAR
An open space extending across the rear of the lot between the side lot lines and measured between the rear lot line and the rear of the main building or any projection other than steps, unenclosed porches or entranceways.
YARD, SIDE
An open space between the main building and the side lot line and extending from the front yard to the rear yard and being the minimum horizontal distance between the side lot line and side of the main building or any projections thereof.
