A. 
The board of appeals shall act as the board of appeals, the relocation appeals board, and the hazardous materials advisory commission (H/M commission).
B. 
The board of appeals shall have jurisdiction over, and shall hear and act upon the following matters:
1. 
Appeals from and determinations by the fire chief and/or building official regarding the suitability of alternative materials and methods of construction, when required, and it shall provide reasonable interpretation and render decisions, pertaining to, and in accordance with, the following:
a. 
The codes promulgated by the California Building Standards Commission, as published in Title 24 of the California Code of Regulations, as adopted and amended by city ordinance, and the International Property Maintenance Code, as adopted and amended by city ordinance.
b. 
City ordinances regarding nuisance abatement, including, but not limited to, the abatement of weeds and vehicles.
2. 
Appeals from and determinations by the relocation director regarding eligibility for, and amount of relocation and replacement housing benefits, when required, and it shall provide reasonable interpretation and render decisions, pertaining to, and in accordance with, California Health and Safety Code Section 33417.5, and California Government Code Section 7266.
C. 
Any decision of the board of appeals pursuant to this section shall be final.

Notwithstanding the powers and duties set forth in Section 2.20.290, and in addition to the powers and duties set forth therein, the board of appeals shall have the following powers and duties:
A. 
It shall hold at least one regular meeting per calendar year and it shall maintain a public record of its transactions of business, which shall include findings and determinations on matters within the scope of its responsibilities. At each regular meeting, its business shall include, but not be limited to, review of the activities of the fire department's hazardous materials program, which is established under the Fire Code published in Title 24 of the California Code of Regulations, as adopted and amended by city ordinance. Minutes of all such meetings shall be forwarded to the city council for review. In addition, the board of appeals shall hold special meetings upon the request of the fire chief, building official, relocation director, hazardous materials manager or city manager.
B. 
It shall periodically review the workings and finances of the fire department hazardous materials program. In addition, it may be called upon to evaluate the proposed operations of businesses that desire to locate within the city of West Sacramento, and it shall make recommendations to the community development department on whether the proposed businesses' use of hazardous material is consistent with the planned location. Any recommendation will indicate whether the business will require a conditional use permit.
C. 
It shall review and comment on response plans and permits prepared pursuant to state law submitted to the board of appeals, in its capacity as the H/M commission, by the fire chief; review and comment on monthly incident reports submitted by the fire chief; request that the fire chief prepare enforcement reports; produce the annual report for the city manager and the city council regarding the status of hazardous materials program; and review and make recommendations to the community development department regarding potential land uses that involve the use, storage, and/or transportation of hazardous material.
D. 
It shall have all the powers and duties set forth in the codes and city ordinances referred to in Section 2.20.290 (Board of appeals—Jurisdiction), and it may recommend to the city council the adoption of new ordinances regarding the subject matter addressed in such codes and ordinances.
E. 
It shall inform the planning commission of any action or decision that may affect the scope of responsibility of the planning commission. During April of each year, a representative of the board of appeals may appear before the city council to report on work accomplished in the past year. Such report, at the discretion of the city council, may be required to be in writing.
F. 
It shall exercise all duties and powers permitted under California Health and Safety Code Section 33417.5, and California Government Code Section 7266 (pertaining to Relocation Appeals).

The board of appeals shall consist of five public members appointed in the manner set forth in Section 2.20.030 of the Municipal Code. Two of the members shall have backgrounds directly associated with architecture, civil engineering, building trades, or fire protection. In filling the remaining three positions, consideration shall be given to applicants with backgrounds in the following categories:
A. 
Toxicology;
B. 
Epidemiology;
C. 
Health education;
D. 
Commercial business;
E. 
Industry;
F. 
Environmental technology;
G. 
Public interest organizations;
H. 
Local neighborhood organizations; and
I. 
Labor organizations.
