The purpose of this article is to ensure compliance with all federal, state, and local requirements, including, but not limited to, the city of West Sacramento Urban Water Management Plan, Water Shortage Contingency Plan, and the State of California Water Conservation Act of 2009 (SBX7-7), relating to water conservation and water shortage mitigation for the protection of public health, safety, and welfare by:
Reducing the per capita water consumption throughout the city of West Sacramento;
Protecting and conserving the city's supply of water during specified times of emergency and/or crisis; and
Minimizing and/or eliminating the waste or unreasonable use of water through voluntary compliance or punitive action, if necessary.

As used in this article, the following terms shall have the specified meanings:
"Rehabilitated landscape"
means any re-landscaping project that requires a permit, plan check, or design review, meets the requirements of Section 13.04.1100, and the modified landscape area is equal to or greater than two thousand five hundred square feet, is fifty percent of the total landscape area, and the modifications are completed within one year.
"Special landscape area (SLA)"
means an area of the landscape dedicated solely to edible plants, recreational areas, areas irrigated with recycled water, or water features using recycled water.
"Water waste" or "unreasonable water use"
means:
1. 
Causing or permitting excessive water to discharge, flow, or run to waste into any gutter, sanitary sewer, water course, or storm drain, or to any adjacent property, from any tap, hose faucet, pipe, sprinkler, or nozzle. In the case of irrigation, "discharge," "flow," or "run to waste" means that the earth intended to be irrigated has been saturated with water to the point that excess water flows over the earth to waste.
2. 
Allowing water fixtures or heating or cooling devices to leak or discharge excessively.
3. 
Backwashing so as to discharge to waste from swimming pools, decorative basins or ponds in excess of the frequency necessary to ensure the healthful condition of the water or in excess of that required by standards for professionally administered maintenance or to address structural considerations.
4. 
Using any city water through a hose for the purpose of washing a vehicle unless the hose is equipped with an automatic shut-off nozzle attachment, and the attachment is being used to shut off flow of water at all times when the hose is not being used to wash the vehicle.
5. 
Operation of an irrigation system that applies water to an impervious surface or that is in disrepair.
6. 
Using city water for landscape irrigation during or within forty-eight hours after measurable rainfall. As used in this subsection, "measurable rainfall" means a rainfall event for which 0.125 inches of precipitation or more is recorded.
7. 
Noncompliance with water use restrictions implemented by the city under its Water Shortage Contingency Plan.
8. 
Failure to fix leaks or faulty irrigation within seventy-two hours of discovery.
9. 
Hosing off sidewalks, driveways, and other hardscapes. This section shall not apply to water-conserving spray cleaning devices (e.g. pressure washers). A simple spray nozzle does not qualify as a water-conserving spray cleaning device.
10. 
Using non-recirculated water in a fountain or other decorative feature.
11. 
Any other actions as determined by the city manager and designee.

No person shall waste or unreasonably use any water furnished to the person's premises by the city. The city may inspect or test meters to determine compliance. The city may take, among other things, the following actions to prevent waste and unreasonable use of water:
A. 
Administer penalties in accordance with Section 13.04.800.
B. 
Disconnect the city's service to any premises and/or customer for the customer's failure to comply with this section.

A. 
All swimming or wading pools installed after the effective date of the ordinance codified in this chapter, which have a capacity of over two thousand gallons of water, and which use water from the city distribution system or which discharge water into the city sewer system, shall be equipped with recirculating systems and filters that meet the performance requirements established by the NSF/ANSI 50-2012 performance standard effective September 2012.
B. 
Pool draining and refilling shall be allowed only to the extent required for health, maintenance, or structural considerations, and must otherwise comply with all applicable federal, state and local laws and stormwater management program requirements.

A. 
All new construction and rehabilitated landscapes shall be installed in accordance with city of West Sacramento Water Efficient Landscaping Code (Chapter 13.04, Article 12).
B. 
Outdoor watering is restricted to three days a week: Tuesday, Thursday and Saturday for premises with odd numbered addresses; and Wednesday, Friday and Sunday for premises with even numbered addresses. No outdoor watering on Monday.
C. 
No person shall use, or cause to be used, any city water for landscape irrigation between the hours of ten a.m. and seven p.m.
D. 
The limitations specified in subsections B and C above shall not apply to landscape irrigation using a low volume irrigation system, nor to the irrigation of container plants, nor to the irrigation of Special Landscape Areas, nor to the irrigation of new landscaping, in that is subject to city of West Sacramento Water Efficient Landscaping Code (Chapter 13.04, Article 12).

A. 
Penalties shall be imposed for violation of any of the provisions of Sections 13.04.770 through 13.04.790, inclusive. Any violations occurring on separate calendar days shall be considered separate violations. The penalty for any violation shall be the amount specified in the city's book of fees.
B. 
Issued written notices must be posted at a conspicuous place on the premises where the violation occurred, or by U.S. mail, first class, postage prepaid addressed to the property billing address.
C. 
The penalties shall be imposed on the owner of the premises where the violation occurs regardless of whether the violation is committed by the owner of the premises or any other person.

Any person may appeal a violation of this chapter in accordance with the provisions of Chapter 1.08 of this code.

Water uses for dust control, curing, compacting, cleaning or other construction use may be subject to limitations and shall not interfere with other domestic uses. Use of recycled water is encouraged where available.

In response to any condition necessitating increased water conservation, such as a water shortage due to drought, natural disaster or other reduction of water supply availability, or as may otherwise be required to protect public health, safety and welfare, the city manager may, in accordance with the city of West Sacramento's Urban Water Management Plan and Water Shortage Contingency Plan declare a water shortage emergency and impose revised and/or additional limitations and time restrictions on outdoor water use while the water shortage remains in effect, and no person shall use, or cause to be used, city water in violation of such limitations or restrictions while the water shortage remains in effect.

A. 
A customer receiving city water service shall provide city employees and/or contractors access to and use of the premises where city water service is received as may be required by the city's employees or contractors to determine whether there is any violation of any of the provisions of Sections 13.04.770 through 13.04.830, inclusive, or to abate any violation thereof. If the customer refuses to allow such access, the city may seek authorization from any court of competent jurisdiction for such access and abatement.
B. 
Compliance with the provisions of this article shall be a condition of the customer receiving or continuing to receive water service.

Nothing in this article shall be construed to apply to the use of city water for purposes of extinguishing fire or any other similar emergency.
