Prior to and during the location or installation
of any dumpster, receptacle or container hereunder, the applicant
must demonstrate compliance with the applicable provisions of the
Village Code and must comply with the following standards:
A. The applicant must produce a certificate of liability
insurance, naming the Village as an additional insured, in an amount
to be determined by the Code Official, but not less than single limits
of $500,000.
B. A separate permit must be requested and obtained for
each dumpster, receptacle or container proposed to be located on a
street, sidewalk or public property.
C. No dumpster, receptacle or container may exceed 30
cubic yards of capacity.

D. Any dumpster, receptacle or container which contains
animal or vegetable refuse shall be kept covered at all times with
a metal cover or other suitable covering approved by the Code Official.
E. No dumpster, receptacle or container may be placed
within 25 feet of any intersection or in any location not approved
by the Code Official.
Any appeal from the refusal of the Code Official
to issue a permit hereunder or the revocation of a permit hereunder
or from the imposition of any condition hereunder shall be made in
writing to the Board of Trustees within 30 days of the determination
by the Code Official. The pendency of any such appeal shall not affect
the efficacy of the determination appealed from.
The provisions of this article shall not apply
to containers or receptacles used for normal residential garbage collections
nor to bundled newspapers which have been placed by the curb for pickup.

A. No person
being the owner or occupant of property shall cause, suffer or permit
any tree, any structure, other object, or any condition to be maintained
on such property in such manner as to cause a hazard or danger of
injury to persons or property, or to cause a hazard or danger to utility
or communications lines, poles, pipes, or other equipment.
B. In any case where the Code Official determines that a violation of Subsection
A hereof exists on any property in the Village, the Code Official may issue a remediation notice to the owner and/or occupant of the property on which such condition exists, directing such owner and/or occupant to take remedial action of a type and within the time specified in such notice.
C. The
Code Official may also provide a copy of such notice to the owner
and/or occupant of any property adjoining the property on which the
dangerous condition is claimed to exist, for the purposes of informing
such owner and/or occupant that the dangerous condition exists on
adjoining property.
D. Any owner or occupant of property who receives notice to remediate a dangerous condition as provided in Subsection
B hereof, and who fails to remediate the dangerous condition within the time period and as directed in such notice, or at such other time or in such other manner as may be approved by the Code Official, shall be guilty of an offense. Upon conviction of any such offense, such person shall be subject to penalties as provided in this Code.
