The existing Police Department is hereby recognized and reestablished
in and for the Borough of Middletown. The Chief of Police shall be
the Chief Executive of the Police Department. He shall, under the
direction of the Mayor, be in charge of the police force and have
supervision over its members in the exercise of their powers, duties
and authority.

Subordinate to the Chief of Police, in the Police Department,
the following classifications are recognized and established: Sergeants,
corporals, patrolmen, part-time patrolmen, Detective Sergeants and
Detectives. The number of persons to serve in each subordinate classification,
on a full-time or a part-time basis, and the compensation of each
shall be as determined by the Borough Council from time to time.
Nothing herein contained shall affect the authority of the Mayor
to appoint special policemen.

A. There is hereby created, in accordance with Section 1313.1 of the
Pennsylvania Borough Code, a sinking fund for the accumulation of capital to repair
and replace capital equipment used by the Police Department as it
becomes obsolete. The sinking fund shall be known as the "Police Sinking
Fund."
B. The Police Sinking Fund shall be used solely to finance the purchase
of new police equipment to be used by the Police Department in the
provision of law enforcement services; repairs to and replacements
of equipment used by the Police Department in the provision of law
enforcement services; construction, renovation, and improvement of
buildings and facilities utilized by the Police Department for police
business; updates to technology infrastructure; and such other capital
improvements as may from time to time be necessary.
C. The Police Sinking Fund shall be funded by income generated by the
Police Department through the collection of fines, fees, and assessments.
D. The Police Sinking Fund shall be under the direction of Borough Council,
in consultation with the Public Safety Committee, and money from the
Police Sinking Fund shall be paid out only upon approval of Borough
Council.
