[Amended 8-29-2023 by L.L. No. 20-2023]
This chapter shall be administered and conducted
under the supervision of the Building Department of the Town of Southold.
The Town's Building Inspectors, however, shall at no time be required
to conduct electrical inspections nor to perform any of the duties
hereinafter assigned to Electrical Inspectors. The fee for electrical
inspections shall be established by resolution of the Town Board.
[Amended 2-4-1992 by L.L. No. 4-1992; 3-10-1992 by L.L. No. 5-1992]
The Chief Inspector and each of the duly appointed
inspectors of the New York Board of Fire Underwriters are hereby designated
as Electrical Inspectors of the Town of Southold and are authorized
and deputized as agents of the Town of Southold to make inspections
and reinspections of all electrical installations heretofore and hereafter
described and to approve or disapprove the same. In no event, however,
will the cost or expense of such inspections and reinspections be
a charge against the Town of Southold. The Town Board may also designate,
by resolution, the Chief Inspector and/or each of the duly appointed
inspectors of organizations other than the New York Board of Fire
Underwriters as Electrical Inspectors and authorize and deputize them
as agents of the Town of Southold to make inspections and reinspections
of all electrical installations heretofore and hereafter described
and to approve or disapprove the same, provided that said inspection
organizations annually submit proof of insurance in such form and
amounts as is deemed satisfactory by the Town Attorney, naming the
Town of Southold as an additional insured.
Any person who violates any provision of this
chapter shall be guilty of a violation and shall, upon conviction,
be subject to a fine of not more than $250 or by imprisonment for
not more than 15 days, or by both such fine and imprisonment, for
each offense.
Should any section or provision of this chapter
be decided by the courts to be unconstitutional or invalid, such decision
shall not affect the validity of the chapter as a whole or any part
thereof other than the part so decided to be unconstitutional or invalid.
This chapter shall take effect immediately.
