The following words, as used in this article, are defined as provided in this section:
BOARD
The Board of Trustees of the Village of Great Neck.
TEMPORARY STRUCTURE
A structure, including a building, which may or may not meet the zoning requirements for the zoning district within which it is located, which will be erected for a short period of time, usually not exceeding two weeks, and then be removed.

A. 
Except as set forth in Subsection B, with regard to dumpsters, no temporary structure, not otherwise permitted by this Code, shall be constructed, installed, or placed on any property within the Village without a permit from the Board.
B. 
Special regulations with regard to dumpsters.
(1) 
When dumpsters are being provided as part of a project for which a building permit has been or is being issued, no additional fee shall be required for permits for the temporary use of the dumpsters when such permits are issued by the Building Inspector, upon the following conditions:
(a) 
The dumpster is placed at a location on the property whereupon the work under the permit is being performed.
(b) 
The dumpster, as to type, size, and location on the property, has been approved by the Building Inspector and is in accordance with such approval.
(c) 
In the event that fencing and/or screening is required by the Building Inspector, such fencing and/or screening is in place and in good condition in accordance with all such requirements.
(d) 
The dumpster is not brought onto the property until the permit has been issued or after such later date, if any, as directed by the Building Inspector.
(e) 
The dumpster is removed from the property prior to the issuance of any certificate of occupancy and/or certificate of compliance or such earlier date, if any, as directed by the Building Inspector.
(2) 
The Building Inspector is authorized to grant permits for dumpsters for periods up to, but not exceeding, two weeks, and, upon a showing of good cause, may extend any such permits for one additional period not exceeding two weeks.
(3) 
No permit for a dumpster, with extensions, may exceed a total of four weeks without the approval of the Board.

The Board, and the Building Inspector with regard to dumpsters, may issue permits for temporary structures, as provided in this article, subject to such time limitations and other terms and conditions as the Board may deem necessary to safeguard adjoining properties and the health, morals, safety, and general welfare of the community.
A. 
The uses permitted in the district in which the property is located, although not restricted to such uses.
B. 
Whether the proposed temporary structure is of such character, size, location, design and site layout as to be appropriate to and in harmony with the surrounding properties for the limited time during which it shall be erected.
C. 
Whether the proposed temporary structure will provide a desirable service, facility or convenience to the community or otherwise contribute to its general welfare.
D. 
The basis for the application and whether the applicant's goals can reasonably be accomplished without the granting of the application or by the grant of a lesser or modified application.
E. 
Whether the proposed temporary structure will be hazardous, conflicting or incongruous to the immediate neighborhood by reason of excessive traffic, assembly of persons or vehicles, proximity to travel routes or congregations of children or pedestrians.
F. 
Whether the proposed temporary structure will be of such a nature as to be objectionable to nearby residential dwellings by reason of noise, lights, vibration, litter or other factors of aesthetics or impact.

The filing fees on applications to the Board shall be as prescribed from time to time by the Board of Trustees.
A. 
Unless otherwise waived by the Board, before an application for a proposed temporary structure may be heard, a complete and accurate list of the names and addresses of the owners of all the lands within a radius of 200 feet of the property affected by such application shall be submitted simultaneously with all applications with regard to nonresidential property and, when requested by the Board, for applications with regard to residential property.

B. 
When required by the Board, the applicant shall send, by certified mail, to each owner shown on said list, not less than 10 nor more than 20 days before the date set for the application to be heard, a notice addressed to such owners generally, signed by the applicant, identifying the property affected thereby and setting forth the temporary structure requested and the date, hour and place when the application will be heard.
C. 
When such notice is requested, before such case may be heard by the Board, the applicant must file with the Clerk of the Board, not later than five days prior to the meeting date at which the Board shall review the application, an affidavit of the mailing of such notices as herein provided. Said affidavit shall be made on forms to be provided by the Village.
This article shall likewise apply to any application for the extension of time to maintain a temporary structure.
