No. 6-2015]
A. Any property owner may request the designation of a landmark, site
or historic district by submitting to the Town Board an application
for such designation on a form furnished by the Historic Preservation
Commission. The Historic Preservation Commission, in addition, may,
on its own motion, initiate proceedings for the designation of a landmark,
landmark site or historic district. In reaching a decision, the Town
Board shall consider the special character, ambience, historical significance,
aesthetic value and uniqueness of architectural design of the proposed
landmark, landmark site or historic district wherever applicable.
B. Within 30 days of the receipt of an application for designation by
a property owner or the Historic Preservation Commission, notice that
such application is being entertained shall be given by the Commission,
by certified mail, return receipt requested, to the owner or owners
of the subject parcel(s) on which the proposed landmark, site or historic
district is situated. Said owner or owners of the subject parcel(s)
shall have the right to confer with the Historic Preservation Commission
at a meeting of the Commission prior to the Commission making a recommendation
on the application to the Town Board. On the scheduling of a Historic
Preservation Commission meeting to consider an application, 14 days'
notice of the meeting shall be given by regular mail to the owners
of all property located within 300 feet of the exterior boundary lines
of the subject parcel(s).
C. The Historic Preservation Commission shall submit its recommendation
to the Town Board within 30 days after the meeting of the Commission
to consider an application. The recommendation may be limited to the
proposed historic district, landmark or landmark site(s) as described
in the application or may include modifications thereof.
D. The Town Board shall call a public hearing to review and pass on
an application within 90 days of the date of receipt of a recommendation
from the Commission.
E. The public hearing called by the Town Board to review an application
shall be advertised in a newspaper of general circulation in the Town
at least 14 days prior to such hearing. A notice thereof shall be
served by certified mail, return receipt requested, postmarked at
least 14 days prior to the date of the public hearing, upon the owner
or owners of the subject parcel(s) as shown by the tax rolls of the
Town. A notice shall be sent by regular mail prior to the public hearing
to every property owner within 300 feet of the exterior boundary lines
of the subject parcel(s).
F. No place, structure or building shall be designated as a landmark
or landmark site, and no area shall be designated as a historic district,
except pursuant to a public hearing duly advertised as herein provided.
G. Within 10 days of the approval or disapproval of the application
by the Town Board, its decision shall be filed with the Town Clerk.
Notice of such decision shall be mailed, certified mail, return receipt
requested, by the Town Clerk to the owner(s) of the subject parcel(s)
and delivered or forwarded by regular mail to the Building Department
and the Historic Preservation Commission.
H. No more than one application shall be submitted as to a subject parcel(s)
within one calendar year of a submission date.
