In order to pay the costs of operation and maintenance of the sewer system, including treatment costs, a user charge shall be levied against each user of the system. This charge shall be in approximate proportion to the user's contribution to the total wastewater loading of the treatment works. Sewer charges shall be levied to the various districts as found in Table 168-T1; provided, however, for users who are outside of any sewer district and do not have a sewer use agreement or sewer tenancy agreement or are in default of an existing agreement or resolution, said users shall pay the sum of $5 per 100 cubic feet of water use or by the amount of wastewater determined by an existing sewer meter, effective January 1, 2010.[2]

This user charge shall be based on water use as measured through the individual user water supply meter and shall be determined by multiplying the metered water use in one-hundred-cubic-foot units by the cost for operation and maintenance per one-hundred-cubic-foot units as established periodically by the Town Board. Where metered water usage is less than 50 one-hundred-cubic-foot units annually, a charge shall be levied based on 50 one-hundred-cubic-foot units.
Where a user is not connected to the municipal water system, the user charge shall be a quarterly charge at the annual rate specified in Table 168-T1[1] in the column labeled "flat." Where the user is a type or class other than a single-family residential dwelling, the Superintendent may require a meter on the user's water supply system. Such meter shall be of a size, type and location approved by the Superintendent.

Where, in the opinion of the Superintendent, pollution concentrations of BOD, suspended solids and/or other pollutants consistently exceed that of domestic sewage, a surcharge may be levied. This surcharge will be based on the formula which follows:

The base level for BOD should be considered as 200 parts per million (ppm) and, for suspended solids, 240 ppm.
C. 
The levy of a surcharge shall be made by the Town Board upon recommendation of the Superintendent and shall become effective 90 days after notification to the user that a surcharge will be levied.
A. 
User charges shall be due and payable quarterly on schedules established by the Sewer and Water Billing Department and shall be subject to a penalty of 10% of the amount due if not paid by the due date.
B. 
Said user charges shall be payable, collectible and enforceable in the manner provided by law and shall constitute a lien upon the real property served by the sewer system within the improvement area to the extent set forth in § 452 of the General Municipal Law of the State of New York. User charges provided herein are charged in addition to any sewer assessment that may be levied from time to time in said improvement area.

All revenues derived from user charges for the disposal of sewage, including penalties and interest, shall be credited to the special fund associated with each district listed in the column labeled "district" of Table 168-T1; provided, however, for users who are outside of any sewer district and do not have a sewer use agreement or sewer tenancy agreement or are in default of an existing agreement or resolution, said users shall pay the sum of $5 per 100 cubic feet of water use or by the amount of wastewater determined by an existing sewer meter, effective January 1, 2010.[1]
