The Board of Commissioners of the Township of
Lower Merion hereby signifies its intention to organize and form a
municipal authority, pursuant to the Municipality Authorities Act
of 1945, Act of May 2, 1945, P.L. 382, as amended.
The name of the municipal authority shall be
the "Ardmore Business District Authority" (hereinafter "Authority").
The Authority shall have the authority and the
purpose thereof shall be to develop and make business improvements,
to provide administrative services and to impose an assessment on
each benefited property in the business district of Ardmore.
The Board of Commissioners of the Township of
Lower Merion hereby retains the right to approve any plan of the Authority
to make business improvements, to provide for administrative services
and to impose assessments on benefited properties in the business
district or to charge for administrative services related thereto.
The Articles of Incorporation of the Authority,
a true and complete copy of which are attached hereto and made a part
hereof, are hereby approved and adopted. The Township Secretary
shall publish notice of the enactment of this article and file the
Articles of Incorporation with the Secretary of the Commonwealth on
or after October 1, 1993.
The term of existence of the Authority shall
be five years from the date this article is enacted, and the Authority
shall automatically terminate unless the Board of Commissioners of
the Township of Lower Merion specifically amends this article to extend
the term of the Authority. No plan for business improvements or administrative services
shall be approved which plan extends for more than five years from
the date this article is enacted unless otherwise amended and approved
by the Board of Commissioners.
