As used in this chapter, the following terms
shall have the meanings indicated:
DAY-CARE CENTER
Includes any privately operated establishment where five
or more children under the age of six years of age are placed or are
regularly received during the day for any period of time while parents
are at work or otherwise engaged. The term "day-care center" shall
not include:
A.
Public or private foster homes, group homes,
residential treatment centers and children's shelters.
B.
Any children's home, orphan asylum, children's
aid society or society for the prevention of cruelty to children subject
to supervision by the State Department of Human Services, except in
the conduct of a philanthropic day-care center.
All day-care centers shall be required to register
annually with the Board of Health of the Borough of Rockaway. Such
registration shall be on forms provided by the Board of Health and
shall contain such information as may be required by the Board of
Health and shall be signed by the registrant or a duly authorized
representative thereof.
All registered day-care centers shall be open
to reasonable inspections conducted by the Board of Health of the
Borough of Rockaway to determine whether the operation and maintenance
of the facilities are in conformity with applicable state and municipal
laws and regulations. The Board of Health shall make available to
all day-care centers information containing said laws and regulations.

The annual registration fee shall be $75, payable
to the Board of Health of the Borough of Rockaway.
The Board of Health of the Borough of Rockaway
shall have the authority to promulgate rules and regulations for the
orderly conduct of day-care centers in furtherance of the purposes
of this chapter. Any such rule or regulation so promulgated shall
be in written form, and notice of such rule or regulation shall be
posted on the municipal bulletin board. A copy of such rule or regulation
shall be sent to all registered day-care centers and to any person
requesting, in writing, to obtain copies of such rules and regulations.
Any rule or regulation thus promulgated shall have the force of law
as if originally incorporated in this chapter.
A day-care center shall be subject to a fine
of no more than $100 for any violation of the provisions of this chapter
or of any rule or regulation promulgated hereunder. A separate violation
shall be deemed to have occurred on each day during which or while
the violation continues.
