It is hereby declared to be the policy of the
Town of Clifton Park to safeguard the right of its residents within
the privacy of their residences to be free from intrusive unwanted
sounds which may jeopardize the well-being, public health, comfort,
convenience, safe being and welfare of its citizens and the peace
and quiet of its inhabitants. The provisions and prodivisions hereinafter
obtained, and enforcement provisions hereinafter obtained, shall not
be utilized or construed in any matter so as to deny any rights or
privileges granted and recognized by the First Amendment of the Constitution
of the United States.
As used in this chapter, the following terms
shall have the meanings indicated:
OTHER DISTRICT
Business Non-Retail District (B-1 and B-2); Neighborhood
Business Districts (B-3); Highway Business Districts (B-4); Corporate
Commerce Districts (B-5); Public/Institutional/Recreational District
(PIR); Light Industrial Districts (L-I); Land Conservation Districts
(L-C); Planned Development Districts (PDD).

RESIDENTIAL DISTRICT
Any district defined in the Zoning Ordinance of the Town of Clifton Park as a "residential district,"
including but not limited to Agricultural/Rural Residential 3 Districts
(R-3); Residential 1 Districts (R-1); Residence Districts (R-1); Residence
Business Districts (R-B); and Special Residential Districts (S-R).

It shall be unlawful for any person to operate
a refuse-collecting vehicle for the purpose of refuse-collecting activities
in a residential district within the Town, or in any other district
in the Town within 500 feet of a residence, during the hours of 7:00
p.m. to 7:00 a.m. daily.

Any person who observes a violation of this
chapter may file a complaint under oath or an affirmation with a Justice
of the Town of Clifton Park or with the Highway Superintendent or
Zoning Enforcement Officer specifying the nature of the violation,
the date and time thereof, a complete description of the vehicle and
operator, including the license plate number, if known. Two complaints,
each originating from separate households, shall be required as the
basis for enforcing the provisions of this chapter.
Any person, firm, association or corporation
who violates any provision of this chapter shall be guilty of an offense
punishable by a fine of not more than $250 and/or by imprisonment
for not more than 15 days. Each violation of this chapter shall be
a separate offense.
Should any provision of this chapter be declared
illegal or unconstitutional by a court of competent jurisdiction to
the extent that the other provisions of this chapter can be implemented
without such illegal or unconstitutional provision, such other provisions
shall remain in effect.
This chapter shall take effect immediately.
