Ownership of the extension shall always be vested
in the Water Department, regardless of the circumstances. The Department
shall prescribe the plan, extent, location, methods, workmanship and
material and have full control of such extensions, including the right
to connect additional customers without the consent of other parties.
The Water Department shall select one of the following methods or a variation or combination of methods that, in its judgment, most appropriately implements the policy stated in §
199-67:
A. Extensions into subdivisions.
(1) When a real estate owner or developer desires and
applies for a main extension into a subdivision, such applicant shall
submit a subdivision map, approved by proper authorities, together
with such other engineering information as the Department may request.
(2) Such main extension as the Department may approve
shall meet specifications as prescribed by the Department and shall
be constructed at the applicant's expense. The actual construction
may be performed by the Department or by the owner or owner's agent
at the option of the Department.
(3) Should construction be by the Department, the owner
must deposit the estimated cost of construction prior to the work.
Should construction be by the owner, a performance bond is required,
and the work shall conform to Department's specifications and inspections
prior to being accepted by the Department.
B. Extensions into existing subdivided area. Upon appropriate action by the Board of Supervisors, the Department may extend existing water mains, with the expense of such extension, or a portion thereof as specified in §
199-67, to be assessed upon the benefited property. Such procedure shall be followed only within the boundaries of the Town of Union.
C. Other extensions. Circumstances that do not conform to either Subsection
A or
B above or that are located outside the Town and in the franchised area will require a special ruling from the Water Department.
D. Extension at Department expense. The Department reserves
the right to construct such mains and service improvements as it may
judge beneficial to the system. Such construction or improvement shall
not obviate any of the conditions of this article.
Any subdivision or main extension which cannot
be functionally supplied with an existing plant and system will require
special arrangements.
The Department shall have the right to make
additional main extensions beyond or laterally from the original.
Further main extensions shall not be considered additional connections
and shall not be a basis for consideration to the original promoters.
The Department shall determine the size and
type of pipe. Should larger than eight-inch size be required for the
traversed territory, such excess cost shall be borne by the Department.
