A Town Planning Commission is hereby created.
Such Commission is to consist of five members, all of whom shall be
residents of the Town, provided that at least 1/2 of the members shall
be freeholders. One of such members may be the Mayor or a member of
the Council, another of whom may be an administrative official of
the Town and the remaining members, hereinafter referred to as "appointed
members," shall be residents of the Town. All of the members shall
be appointed by the Town Council. The terms of the councilmanic members
and of any administrative official who is appointed as a member of
such Commission shall in all cases correspond with their terms of
office. The remaining members of the Commission first appointed shall
serve respectively for terms of one year, two years, three years and
four years. Their successors shall be appointed for terms of four
years. Any vacancy in the membership shall be filled by appointment
by the Council, and such appointment shall be for the unexpired term.
Any appointed member may be removed by the Council for malfeasance
in office, provided that such removal may be made only after a public
hearing at which such member shall be given an opportunity to appear
and be heard on the charge against him. Notwithstanding the foregoing
provision, a member of the Planning Commission may be removed from
office by the Town Council without limitation in the event that the
Commission member is absent from any three consecutive meetings of
the Commission, or is absent from any four meetings of the Commission
within any twelve-month period. In either such event, a successor
shall be appointed by the Town Council for the unexpired portion of
the term of the member who has been removed. All members of the Town
Planning Commission shall serve as such without compensation.
The Town Planning Commission shall have the
functions, powers and duties which are prescribed by law.
