The purpose of this district is to protect the
Village of Naples water supply, in particular the wellhead located
on Rt. 245 in the Village of Naples.
A. The remedial zone within a two-hundred-foot radius
of the wellhead shall be zoned L-C with special restrictive provisions:
(1) No building or construction in the zone.
(2) No fertilizer to be discharged in the zone.
B. The wellhead protection zone shall include the entire
Village of Naples.
C. The discharge of any pollutants or contaminates on
or into the ground anywhere within the Village boundaries, except
for residential and commercial septic systems effluent, shall be prohibited.
In addition to other penalties, violators will be required to remove
any pollutants so discharged.
D. The discharge of pollutants and/or contaminates into
the Naples Creek and tributaries shall be prohibited. For the purpose
of this section, the following terms shall have the meanings indicated:
CONTAMINATES
Any material that when mixed with water renders unfit for
human, animal or aquatic use.
HAZARDOUS MATERIAL
Any substance defined or listed in 6 NYCRR 597.1 through
597.2, as amended from time to time.
HERBICIDES
Any substance or mixture of substances intended for preventing,
destroying, repelling, or mitigating any weed, as defined in Environmental
Conservation Law § 33-0101.
PESTICIDE
Any substance used to destroy or inhibit pests as defined
in 6 NYCRR 325.1, as amended from time to time.
POLLUTANT
Any material, liquid or solid, that renders the soil or water
impure or unsatisfactory for human use, including hazardous wastes
listed in the New York State regulation 6 NYCRR 371.
E. Repair of existing septic systems and the installation
of new septic systems shall require a wastewater treatment permit.
F. All of the above shall be conducted under the direct
supervision of the Village Code Enforcement Officer or the Canandaigua
Lake Watershed Inspector.
