Accumulation of combustible waste or litter
of any kind on vacant lots or in any open space is hereby prohibited.

The owners of vacant lots or open spaces of
any kind shall not permit them to become infested with any overgrowth
of grass, vines, ragweed or other weeds and/or vegetation which may
constitute a fire hazard, a nuisance or a menace to the health and
welfare of the residents of the Borough of South River.

A. It shall be the duty of the Director of Public Works
and Deputy Director of Public Works to report to the Mayor and Council
from time to time on the condition of such vacant lots and open spaces
within the Borough.
B. When, in the opinion of the governing body, there exists a violation of the provisions of §
258-2 of this chapter on any vacant lot or open space within the Borough, the Borough Clerk shall cause to be served upon the owner of the property a written notice of violation, advising the owner of the nature of the violation, directing the owner to remove all such overgrowth within seven days of receipt of such written notice and advising the owner that failure to do so shall result in the necessary work being accomplished by the Borough, with the cost thereof to be assessed against the owner and to become a municipal lien against the real property. Upon the failure of the owner to comply with said notice, the governing body may proceed forthwith to act in accordance with the terms of the aforesaid notice.

Violation of this article shall be punishable as provided in Chapter
1, Article
I, General Penalty. This provision shall be construed to provide a penalty in addition to that set forth in §§
258-3B and
258-4B of this article.
