The terms used in this chapter shall be deemed and construed to have
the following meanings:
DEVELOPER
Any person who, either directly or through agent or independent contractor,
engages or intends to engage in land subdivision or development or in the
construction of two or more dwelling houses, business or industrial buildings
in any subdivision for the purpose of sale to or occupancy by another person
or persons.
EXCAVATOR
Any person, firm or corporation, partnership or association engaged
in the moving, removal or excavation of soil or topsoil from, in or upon any
land in the Borough.
MAJOR SOIL REMOVAL OPERATIONS
All soil removal operations involving the removal of more than 50,000
cubic yards of material.

MINING
An extractive process involving the removal of sand, clay, gravel,
humus, peat and other organic or mineral materials.
MINOR SOIL REMOVAL OPERATIONS
All soil removal operations which involve the removal of less than
50,000 cubic yards of material and which do not present unique physical features,
drainage problems or conditions causing unusual amounts of engineering and
inspection work.

MOVE
To dig, excavate, to remove; to deposit; to place and to fill; to grade, regrade, level or otherwise alter or change the location or contour; to transport and to supply. (See exclusions as more particularly set forth in §
284-27 of Article
X.)
OWNER
Any person seized in fee simple of any land or having such other
interest or estate therein as will permit the exercise of effective possession
thereof or dominion or control thereover.
PERSON
Any individual, firm, association, partnership or corporation, or
any group of two or more of them.
PREMISES
One or more contiguous parcels of land in single ownership. Parcels
shall not be deemed to be contiguous if separated by a road, railroad, right-of-way,
brook, stream or other natural division.
SOIL
Any earth, sand, clay, loam, gravel, humus, rock or dirt, irrespective
of the presence or absence therein of organic matter.
TOPSOIL
Soil that, in its natural state, constitutes the top layer of earth
and is composed of 2% or more by weight of organic matter and has the ability
to support vegetation.
