Every owner, lessee, tenant, occupant or other person having charge of any building or lot of ground in the Town abutting upon any street, avenue or public place where the sidewalk is paved or in the fire limits shall, within four hours, and elsewhere within 10 hours, after the snow ceases to fall, remove the snow and ice from such sidewalk, the time between 7:00 p.m. and 7:00 a.m. not being included in the above period of four hours and 10 hours respectively; provided, however, that such removal shall in all such cases be made before the removal of snow and ice from the roadway by the Superintendent of Highways or subject to the regulations of said Superintendent for the removal of snow and ice. When any ice forms upon any sidewalk, it shall be the duty of such persons to place thereon sufficient sifted ashes or sand to prevent persons from slipping until such ice shall be wholly removed. Any owner, lessee, tenant, occupant or other person who has charge of any ground abutting upon the paved sidewalks of any street, avenue or public place for a linear distance of 500 feet or more shall be considered to have complied with this article if such person shall have begun to remove the snow and ice from the sidewalk and gutter before the expiration of said four hours and 10 hours respectively and shall continue such removal and shall complete it within a reasonable time.
A. 
Whenever any owner, lessee, tenant, occupant or other person having charge of any building or lot of ground abutting upon any street or public place where the sidewalk is paved shall fail to comply with the provisions of this article on the side of the street on which such building or lot abuts, the Superintendent of Highways may cause such snow and ice to be removed, meeting the expense thereof from any suitable fund, and thereafter the expense of such removal as to each particular lot of ground shall be ascertained and certified by said Superintendent of the Town Board.
B. 
The Town Board is hereby directed and authorized to sue for and recover in the name of the Town of Harrison the amount of this expense, together with a penalty of not more than $15 and not less than $5 for each offense, and when so recovered, the amount shall be turned over to the Supervisor to be deposited to the credit of the general fund of the Town of Harrison.

Any person violating any of the provisions of this article shall, upon conviction, be punishable by a fine not to exceed $250 or by imprisonment for a term not to exceed 15 days, or both.
