As used in this chapter, the following terms shall have the meanings indicated:
APPEARANCE TICKET
Written notice issued and subscribed by a public servant authorized by local law enacted pursuant to the provisions of the Municipal Home Rule Law to issue the same.
PUBLIC SERVANT
Those city officials who, by virtue of their office, title or position, are authorized or required to enforce statutes, local laws, ordinances, rules or regulations relating to fire prevention, safety, health, sanitation, building, zoning and planning. These city officials are to include but not be limited to the Fire Chief, the Code Enforcement Officer or their designee.
The purpose of this chapter is to authorize certain public servants of the City of Hornell to issue and serve appearance tickets in connection with violations of state statutes, local laws, ordinances or rules and regulations of the city which the public servants are authorized or required to enforce.
The Code Enforcement Officer, the Fire Chief, the Health Officer, the Dog Control Officers, as designated by the Common Council, and any designee of the Board of Public Safety or the Board of Public Works of the City of Hornell are hereby authorized to issue and serve appearance tickets with respect to violation of any state statute, local law, ordinance, rule or regulation of the City of Hornell that said public servant has been heretofore required or authorized to enforce.
The appearance ticket hereby authorized shall substantially conform to the specimen described in Appendix 1 hereto annexed.[1]
