[HISTORY: Adopted by the Special Town Meeting of the Town of Guilford 2-9-1966; amended in its entirety at time of adoption of Code (see Ch. 1, General Provisions, Art. I). Subsequent amendments noted where applicable.]
As used in this chapter, the following terms shall have the meanings indicated:
GRILL, BARBECUE or OUTDOOR FIREPLACE
Any masonry or metal structure used only for cooking outdoors and not used for any disposition of material specified in the definition of "outdoor fire."
OUTDOOR FIRE
Any fire in the open air or outside the confines of a building for the purpose of:
A. 
Burning woodland, grassland, swampland, leaves or debris.
B. 
Burning, as a means of disposal, of papers, rubbish, garbage or any other type of combustible when such burning is done in the open air, outside of a structure.
C. 
Burning, as a means of disposal, of all or any part of any structure or vehicle, including automobiles, boats and aircraft, and the burning of debris from any of the foregoing.
PERMIT
Written permission from the Fire Marshal or a person or persons designated by the Fire Marshal to give outdoor burning permits, in such form or detail and valid for such period of time as the Fire Marshal shall prescribe.
A. 
No person shall kindle an outdoor fire within the Town of Guilford without a permit. This does not apply to an outdoor grill or fireplace used for cooking.
B. 
No person shall kindle an outdoor fire unless the location is not less than 50 feet from any structure and adequate provision is made to prevent the fire from spreading to within 50 feet of any structure or other combustible material in an uncontrolled manner.
Burning of outdoor fires shall be done only during the period from 10:00 a.m. to 5:00 p.m., unless otherwise authorized by the Fire Marshal.
An outdoor fire shall be constantly attended by a competent person until such fire is extinguished. This person shall have extinguishing equipment readily available for use.
The Fire Chief or the Fire Marshal may prohibit any or all outdoor fires when atmospheric or local circumstances make such fires hazardous.
Any person who violates any provisions of this chapter shall be subject to the penalties provided in Section 23-48 of the Connecticut General Statutes.
