As used in this article, the following terms shall have the meanings indicated:
ASSISTED LIVING FOR THE ELDERLY
Dwelling units for elderly occupancy in two- or three-storied structures, which provide three meals per day, personal care services, transportation and housekeeping services.
ASSISTED LIVING SERVICES
Nursing services and assistance with activities of daily living provided to clients living within a managed residential community having supportive services that encourage clients primarily age 55 or older to maintain a maximum level of independence. Routine household services may be provided as "assisted living services" by the assisted living services agency or by the managed residential community as well as providing an alternative for elderly persons who require some help or aid with activities of daily living or nursing services in order to remain in their private residential units within the managed residential community. Services are defined and/or described in regulations of Connecticut State Agencies and/or future federal guidelines that may be promulgated regarding assisted living services or facilities.
REGULATIONS OF CONNECTICUT STATE AGENCIES
Section 19-13-D105 of the Regulations of Connecticut State Agencies.
A. 
Building permits. No person shall apply for a building permit for the construction of any structure designed and approved for the purpose of either providing assisted living for the elderly or assisted living services unless it first registers with the Town Clerk of the Town of Rocky Hill a certificate in a form to be prescribed by the Building Department which shall contain the following information:
(1) 
The location of the property to be designated for the purpose.
(2) 
The name and address of the owner of the real property for the facility being constructed.
(3) 
The name of the licensed assisted living services agency that will be providing services to the managed residential community.
(4) 
A photocopy of the license issued by the State of Connecticut for the operation of the assisted living services agency issued pursuant to the regulation of the State of Connecticut as well as Section 19a-491 of the Connecticut General Statutes.
B. 
Certificates of occupancy.
(1) 
No person shall convert, use or offer to the public for future use any existing structure for the purpose of either providing assisted living for the elderly or assisted living services unless it first registers with the Town Clerk of the Town of Rocky Hill a certificate in a form to be prescribed by the Building Department which shall contain the following information:
(a) 
The location of the property to be designated for the purpose.
(b) 
The name and address of the owner of the real property for the facility being constructed.
(c) 
The name of the entity that will be providing the services.
(d) 
A photocopy of the license issued by the State of Connecticut for the operation of the facility issued pursuant to the regulation of the State of Connecticut as well as Section 19a-491 of the Connecticut General Statutes.
(2) 
Upon said filing the Building Department, in a form it shall prescribe, shall issue a certificate of use and occupancy which shall, in addition to all other requirements, certify that said person has complied with this section.
C. 
Compliance. No person shall use or offer to the public for future use within any structure located in the Town of Rocky Hill any assisted living for the elderly or assisted living services unless he/she first complies with the pertinent sections of this article. Each occurrence shall constitute a separate and distinct violation and carry with it a penalty of $99 per day, per violation.
