Pursuant to the provisions of the State Construction Code, in
accordance with Section 8b(5) of P.A. 230 of 1972, as amended, the Director of the Department of Construction Codes for
Eaton County is hereby designated as the Enforcing Officer to discharge
the responsibilities of the Floodplain Management Provisions of the
Michigan Building Code by adoption of this chapter.
Pursuant to the provisions of the State Construction Code, in
accordance with Section 8b(5) of P.A. 230 of 1972, as amended, Appendix
G of the Michigan Building Code has been adopted by, and will be enforced
by, the Eaton County Department of Construction Codes within the boundaries
of the Village of Bellevue, located within Eaton County.
The Federal Emergency Management Agency (FEMA) Flood Insurance
Study (FIS) entitled Eaton County, Michigan (All Jurisdictions) and
dated November 26, 2010, and the Flood Insurance Rate Map(s) (FIRMs)
panel number(s) of 26045C; 0385E and 0395E and dated November 26,
2010, are adopted by reference for the purposes of administration
of the Michigan Construction Code, and declared to be a part of Section
1612.3 of the Michigan Building Code, and to provide the content of
the "Flood Hazards" section of Table R301.2(1) of the Michigan Residential
Code.
All ordinances in conflict with this chapter are repealed only
to the extent necessary to give this chapter full force and effect.
The various parts, sections and clauses of this chapter are
hereby declared to be severable. Should any part, clause, sentence,
paragraph or section of this chapter be found invalid or unconstitutional
for any reason by any court of competent jurisdiction, any such decision
shall not affect the validity of the remainder of this chapter.
All proceedings pending and all rights and liabilities existing,
acquired or incurred at the time this chapter takes effect are saved
and may be consummated according to the law in force when they were
commenced.
The provisions of this chapter are ordered to take effect 30
days after publication.
