As used in this article, the following terms shall have the meanings
indicated:
GAMBLING
Any activity which is conducted without a state license, such as
dice or card games, which is performed for money or anything of value, where
the outcome of the contest or a future contingent event is not under the actor's
control or influence, and there is an agreement or understanding that something
of value will be received in the event of a certain outcome.
PUBLIC GAMBLING
Gambling which occurs within the City in any public or quasi-public
place, including, but not limited to, any public street, alley, sidewalk,
park, playground, public conveyance, parking facility or in any municipal
building.
No person shall, for money or other valuable thing, play or engage in
faro, roulette, dice, card games or any games of chance, and no person shall
aid, abet, assist or participate in any of the foregoing prohibited activities.
Public gambling, as defined above, is deemed a nuisance and is prohibited.
This article shall not be construed to apply to the conducting of games
of chance commonly known as "bingo" or "lotto" under a license duly issued
under the provisions of the Bingo Licensing Law (N.J.S.A. 5:8-31), and to
the conducting of games of chance commonly known as raffles under a license
duly issued under the provisions of the Raffles Licensing Law (N.J.S.A. 5:8-58).
The holding, conducting and operation of raffles within the City shall
be subject to and in accordance with all the terms and provisions of the Raffles
Licensing Law (N.J.S.A. 5:8-31), as amended or supplemented, and to all general
rules and regulations promulgated, or to be promulgated, by the Legalized
Games of Chance Control Commission.
The holding, conducting and operation of bingo within the City shall
be subject to and in accordance with all the terms and provisions of the Bingo
Licensing Law (N.J.S.A. 5:8-58), as amended or supplemented and to all general
rules and regulations promulgated, or to be promulgated, by the Legalized
Games of Chance Control Commission.
It shall be lawful to conduct, hold and operate games of chance commonly
known as "bingo," "raffles" and "lotto," as provided in N.J.S.A. 5-8.31 and
5-8.58, on the first day of the week, commonly known and designated as Sunday,
and in accordance therewith, proper provision therefor shall be made in the
license.
The City Council of the City, being the governing body of the City, shall constitute the authority for the administration of the issuance of licenses under §§
118-4 and
118-5.
