For the purpose of this chapter, the terms, phrases, words and
their derivations set out in this chapter shall have the meanings
given them in this chapter. When not inconsistent with the context,
words used in the present tense include the future, words in plural
number include the singular number, and words in the singular number
include the plural number. The word "shall" is always mandatory and
not merely directory.
As used in this chapter, the following terms shall have the
meanings indicated:
ALLEY
A minor way which is used primarily for vehicular service
access to the back or the side of properties otherwise abutting on
a street.
ARTERIAL STREET
A heavy-traffic street of considerable continuity and used
primarily as a traffic artery for travel among large areas.
COLLECTOR STREET
A street which carries traffic from minor streets to arterial
streets, including the principal entrance streets of a residential
development and streets for circulation within such a development.
CONDOMINIUM
A form of real property with portions of the real property
designated for separate ownership or occupancy, and the remainder
of the real property designated for common ownership or occupancy
solely by the owners of those portions. Real property is a condominium
only if one or more of the common elements are directly owned in undivided
interests by the unit owners. Real property is not a condominium if
all of the common elements are owned by a legal entity separate from
the unit owners, such as a corporation, even if the separate legal
entity is owned by the unit owners.
ENGINEER OF RECORD
The engineer who signs and stamps the construction documents
to indicate conformance to the project requirements.
FINAL PLAT
The final map, drawing or chart on which the subdivider's
plan of subdivision is presented to the Town Council for approval,
and which if approved will be submitted to the County Clerk for recording.
LOT
A parcel or portion of land in a subdivision or plat of land,
separated from other parcels or portions by description as on a subdivision
or record of survey map or by metes and bounds, for the purpose of
sale or lease to, or separate use of, another.
MARGINAL ACCESS STREET
A minor street which is parallel and adjacent to arterial
streets and which provides access to abutting properties and protection
from through traffic.
MASTER PLAN
A comprehensive plan prepared or to be prepared by the Planning
and Zoning Commission which indicates the general locations recommended
for the various functional classes of public works, places and structures
and for the general physical development of the Town, and includes
any unit or part of such plan separately adopted and any amendment
to such plan or parts thereof.
MINOR STREET
A street used primarily for access to the abutting properties.
OFFICIAL MAP
The map established by the Town Council showing the streets,
highways and parks theretofore laid out, adopted and established by
law and any amendments thereto adopted by the Town Council or additions
thereto resulting from the approval of subdivision plats by the Town
and the subsequent filing of such approved plats.
OWNER
Any individual, firm, association, syndicate, partnership,
corporation, trust or any other legal entity having sufficient proprietary
interest in the land sought to be subdivided to commence and maintain
proceedings to subdivide the same under this chapter.
PERSON
Any individual, firm, association, syndicate, partnership,
corporation or any other legal entity.
PRELIMINARY PLAT
The preliminary map, drawing or chart indicating the proposed
layout of the subdivision to be submitted to the Town Council or the
Planning and Zoning Commission for its consideration.
STREET
A way for vehicular traffic, whether designated as a street,
highway, thoroughfare, parkway, throughway, road, avenue, boulevard,
lane, place or however otherwise designated.
SKETCH PLAN
A basic concept drawing of the proposed subdivision.
STREET WIDTH
The shortest distance between the lines delineating the right-of-way
of a street.
SUBDIVIDER
Any individual, firm, association, syndicate, partnership,
corporation, trust or any other legal entity commencing proceedings
under this chapter to effect a subdivision of land under this chapter
for himself, for herself, for itself or for another.
SUBDIVISION
A division of a parcel of land into two or more lots or parcels;
or, if a new street is involved, any division of a parcel of land.
A subdivision includes a division of a building, or lot of record
for purposes of creating condominiums or townhomes. Where the land
sought to be divided was, itself, the subject of a prior division,
or where the land sought to be divided is a lot or parcel in a previously
platted addition or subdivision, it is included in this definition.
A division which is created solely by a conveyance to or from the
Town of Pinedale shall not be considered a subdivision.

THIRD-PARTY ENGINEER
An engineering firm independent of both the subdivider and
the engineering firm hired by the subdivider.
TOWNHOUSE
A single-family dwelling unit constructed in a group of two
or more attached units in which each unit extends from foundation
to roof and with a yard or public way on at least two sides.
