Pursuant to the provisions of § 4.07 of Article 66B of the Annotated Code of Maryland there is hereby established a Town Board of Appeals which shall have all the powers and duties as set forth in Article 66B, § 4.07, as amended from time to time.

With respect to the Board of Appeals generally, Article 66B, § 4.07, as amended from time to time, is hereby incorporated by reference and made a part hereof.
The Board of Appeals shall consist of five members and one alternate member who may be empowered to sit on the Board in the absence of any member of the Board. When the alternate is absent, the Board of Town Commissioners may designate a temporary alternate. Each member and the alternate shall be a resident of the Town and shall have maintained such residency for a minimum of one year. At no time shall the Board hear cases with fewer than three members present.
