A. 
Rules and regulations. The Director of Public Safety shall compile, review and periodically revise with division heads rules and regulations governing the divisions of the Department of Public Safety.
B. 
Departmental structure. The Director of Public Safety shall examine the tables of organization prescribed by the Chief of Police and the Fire Chief and make appropriate recommendations to the Mayor.
C. 
Departmental meetings. The Director of Public Safety shall meet with each division head within the Department of Public Safety on a weekly basis or at other times deemed necessary to review departmental matters and shall issue reports to the Mayor as to matters reviewed at such meetings.
D. 
Ordinance and local law proposals. The Director of Public Safety shall submit to the Council proposals for ordinances and local laws in the field of public safety.
E. 
Annual report. It shall be the duty of the Director of Public Safety to compile an annual report describing the activities of the Department of Public Safety.
F. 
Hearing officer. The Director of Public Safety shall act as a hearing officer in cases where charges are brought against members of the Department of Public Safety and shall impose the punishment which he or she deems appropriate under the rules and regulations of the department and the Civil Service Law and other applicable state law.
G. 
Division heads.
(1) 
Direction and orders. It shall be the duty of the Director of Public Safety to direct the division heads of the Department of Public Safety, either orally or in writing, to carry out specific actions for the improvement of the functions of the Department.
(2) 
Failure of division heads to comply with directives. In the event of noncompliance by a division head with any directive issued pursuant to Subsection A, the Director of Public Safety shall take such action as he or she deems appropriate to suspend, remove or otherwise discipline such division head pursuant to law.
The Director of Public Safety shall designate a qualified medical doctor to serve as Police and Fire Surgeon. The Police and Fire Surgeon shall, under the direction of the Director, validate daily any extended absence of members of the Department because of sickness. The Director shall confer with the Police and Fire Surgeon and his or her subordinate administrative heads, but they shall be the sole judge of whether such absences were the direct result of service-connected injuries and the appropriate interpretation of the rules and regulations of the Department with respect to such absences.
The Supervisor of the Bureau of Communications, under the supervision of the Director of Public Safety, shall:
A. 
Operate system. Administer the operation of all telephone, teletype, and radio communication systems within the Department of Public Safety.
B. 
Centralize and coordinate system. Centralize and coordinate the operation of such system to provide and promote the maximum efficiency and economy in the use thereof.
C. 
Maintain and repair system. Be responsible for the preservation and repair of communications equipment.
D. 
Render services. Render such services to the Police and Fire Division as shall be directed.
If there be an appropriation in the budget by the Council, the Director of Disaster Preparedness, under the Supervision of the Director of Public Safety, shall:
A. 
Preparations. Carry out the duties and powers vested in him or her by law for the protection of persons and property in disaster preparedness operations.
B. 
Inspection reports. Submit to the Director of Public Safety such reports as shall be prescribed.
The Dog Control Officer, under the supervision of the Director of Public Safety, shall:
A. 
Enforce licensing. Enforce the provisions of law relating to the licensing of dogs.
B. 
Rules and regulations. Prescribe such rules and regulations as he or she deems necessary for the proper control of dogs and other household pets.
C. 
Programs for rodent extermination. The Dog Control Officer shall carry on programs for the effective extermination of rodents.
The Director of Weights and Measures, under the supervision of the Director of Public Safety, shall:
A. 
Duties pursuant to state law. Perform in the City the duties of and shall have like powers as a County Sealer as more particularly described in § 181 of the Agriculture and Markets Law.
B. 
Inspection and reports. Conduct such inspections and submit such reports as shall be prescribed by the Director of Public Safety and by law.
A. 
Appointment; term. The Director of Public Safety shall appoint Special Court Marshals, and the number of such Special Court Marshals appointed shall be in accordance with his or her discretion. The term of appointment shall be for one year.
B. 
Badges. The Director of Public Safety is hereby authorized to prescribe the style, form and size of a badge to be known and designated as Special Court Marshal badge. Each Special Court Marshal shall provide himself or herself, at his or her own expense, with one such badge.
C. 
Authority. The authority of a Special Court Marshal extends throughout the City of Lackawanna; he or she may serve a summons, petition, notice of petition, subpoena or other paper that may be served by any person in a like instance in the Supreme Court.
A. 
Fire Chief. The Fire Chief shall be charged with the prevention of fires and the protection of life and property against fire.
B. 
Fire losses. It shall be the duty of the Fire Chief to report all real property fire losses in excess of $500 to the City Assessor.
C. 
Property and equipment. The Fire Chief shall be responsible for the maintenance and care of all property and equipment used by his or her Division.
D. 
Bureaus of Fire Division. The Division of Fire shall be divided into the following bureaus and each bureau shall be supervised as set forth herein:
(1) 
Fire-Fighting Bureau. The Fire-Fighting Bureau shall be supervised by a commissioned officer, who shall be responsible for:
(a) 
Extinguishment of fire;
(b) 
The saving of life and property from fire; and
(c) 
The performance of various miscellaneous public services of an emergency nature.
(2) 
Fire Prevention Bureau. The Fire Prevention Bureau shall be supervised by a Fire Inspector, who shall be responsible for:
(a) 
The inspecting of potential fire hazards;
(b) 
The abatement of existing fire hazards; and
(c) 
The conducting of an educational fire prevention program.
A. 
Chief of Police. The Chief of Police shall direct the police work of the City and shall be responsible for the enforcement and maintenance of law and order.
B. 
Assignment of officers. The Chief of Police shall assign officers to each bureau of the Police Division.
C. 
Reassignment of officers and personnel. Reassignment of officers and personnel from one bureau to another within the Police Division shall be made only by the Chief of Police.
D. 
Police Instructor. Pursuant to the City Charter, the Chief of Police shall designate from among regular personnel a commissioned officer of the Police Division to act as Police Instructor in addition to his or her regularly assigned duties. Such officer shall conduct such schools as the Chief shall order.
E. 
Fingerprinting; fees.
(1) 
To help alleviate the workload, increase City revenue and to help defray the cost of supplies, the following fees or charges shall be collected by the Division of Police and such monies shall be deposited with the City Treasurer:

(a) 
Pistol permits: $20.
(b) 
Additional fingerprint cards: $5 each.
(c) 
Record checks: $6.
(d) 
Identification photos, six copies or less: $10.
(e) 
Photo copies of police reports with no charge for residential victims: $10.
(2) 
The above charges shall be collected from all persons and corporations requesting same except from any regular police agency, state agency or federal agency.
A. 
Appointment.
(1) 
Authority of Director of Public Safety; examination of applicant. The Director of Public Safety shall have power to appoint any number of special police officers to do special duty within the City. Any person who is an applicant for appointment as a special police officer shall appear in person for examination at such place or places as may be designated by the Director of Public Safety.
(2) 
Investigation of applicant; residence requirements. Before appointing any person a special police officer, the Director of Public Safety shall first cause an investigation of the character of the applicant to be made; and he or she shall refuse to appoint any one a special police officer unless, as a result of the said investigation, the character of the applicant is found to be satisfactory and above reproach. No person shall be appointed a special police officer unless he or she is a citizen of the United States and is an actual resident of the City.
B. 
Certificate of appointment; expiration, renewal of certificate; oath of office. The Director of Public Safety shall issue a special certificate of appointment to each special police officer, which certificate shall expire one year from the date of its issuance. The Director of Public Safety shall have the power to renew any such appointment for a period of one year, and he or she shall keep a correct list of all persons so appointed. Upon the original appointment, a special police officer must take an oath of office and file same with the City Clerk. Upon renewal of appointment, no further oath of office shall be required.
C. 
Fingerprinting of applicants. Each applicant shall appear at the Bureau of Identification for the purpose of having fingerprints taken.
D. 
Badges; display of badge. The Director of Public Safety shall provide each such special police officer with a suitable badge. Every special police officer so appointed shall wear the badge issued to him or her as herein provided upon the outside of his or her outer coat or if not wearing a coat, upon the outside of his or her outer shirt, while engaged in the performance of police duty. Upon termination of appointment, the badge shall be returned to the Director of Public Safety.
E. 
Approval of badges, insignia, uniforms. It shall be unlawful for any person appointed a special police officer to wear or display any badge, insignia, cap, device, button or uniform unless the same shall have first been approved by the Director of Public Safety.
F. 
Supervision; rules and regulations. Persons so appointed special police officer shall report in person to the Director of Public Safety in such manner as shall be required of him or her. They shall conform to and be subject to all rules and regulations governing police officers of the City, and to such additional rules and regulations as the Director of Public Safety may make concerning special police officers.
G. 
Powers. Persons so appointed special police officers shall possess all the powers of the regular police officers.
H. 
Firearms. Every person so appointed as a special police officer is required to have a license pursuant to § 400.00 of the Penal Law to possess and/or carry a pistol, revolver or firearm. The authority of a special police officer to possess a pistol, revolver or firearm is subject to the discretion of the Director of Public Safety.
I. 
Removal or discharge. Persons so appointed special police officers may be removed or discharged from service at any time by the Director of Public Safety, without assigning any cause therefor, and any person so discharged or removed shall immediately return the certificate of appointment and the badge issued to him or her to the Director of Public Safety.
J. 
False impersonation of special police officers; penalty. Any person who shall falsely assume or pretend to be a special police officer or who shall falsely display any badge designated by the Director of Public Safety shall be guilty of a violation and shall be fined not less than $25 and not more than $250 for each offense.

K. 
Penalty for violation of section. Any person who shall violate any of the provisions of this section for which no other penalty is provided shall be guilty of a violation and shall be fined not less than $10 and not more than $250 for each offense.
