No person, firm, association, or corporation shall construct any drains or storm sewers in the rights-of-way of the streets of the Borough of Brookville without first obtaining a permit from the Borough.
The property owner involved, or his representative, shall apply for such permit and in his application a full description of the proposed drain or storm sewer shall be given, including:
A. 
The exact location of the proposed drain or sewer;
B. 
A description of the pipe or other material that the owner proposes to use;
C. 
A description of the manner in which the proposed construction of said drain or sewer is to be carried out;
D. 
Any other pertinent information.
Prior to the granting of any permit, the Borough Engineer shall investigate and determine whether or not the proposed drain or storm sewer is:
A. 
Properly located;
B. 
Of sufficient size for its intended purposes;
C. 
Of sufficient strength to carry the weight proposed to be placed upon it at its particular location;
D. 
Good engineering.
If the proposed construction of said drain or storm sewer meets with the approval of the Borough Engineer, a permit shall be granted. However, if the proposed construction does not meet with the approval of the Borough Engineer, he shall forthwith inform the applicant of his reasons for disapproval.

A fee in the amount set from time to time by resolution of the Borough Council shall be charged by the Borough and said fee shall be paid at the time the application is filed.

Any person, firm, association, or corporation violating any provision of §§ 115-1 through 115-5 of this article shall, upon conviction thereof, be sentenced to pay a fine of not more than $600, plus costs of prosecution, and, in default of payment of such fine and costs, to imprisonment for not more than 30 days; provided each violation of any provision of this article, and each day the same continues, shall be deemed a separate offense.

No person shall discharge or cause to be discharged any of the following described wastes into the storm sewer systems of the Borough of Brookville:
A. 
Any gasoline, benzene, naphtha, fuel oil or other flammable or explosive liquid, solid or gas.
B. 
Any garbage.
C. 
Any ashes, cinders, sand, mud, straw, shavings, metal, glass, rags, feathers, tar, plastics, wood, manure, or any other solid or viscous substance capable of causing obstruction to the flow of storm sewer lines or other interference with the proper operation of the public storm sewer system.

The placing of any of the items listed in § 176-7 of this article upon the sidewalks or streets of the Borough in such a manner as to be discharged or flow into the storm system shall constitute a violation of this article.

Any person who shall violate any of the provisions of §§ 115-7 or 115-8 of this article shall, upon conviction thereof, be sentenced to pay a fine of not more than $600, plus costs of prosecution, and, in default of payment of such fine and costs, to imprisonment for not more than 30 days.
