A. 
It shall be unlawful for the owner of any land within the jurisdiction of the Town to which these regulations may apply, or any other person, firm or corporation, to subdivide any lot, tract or parcel of land or lay out, construct, open or dedicate for public use or travel any street, sanitary sewer, storm sewer, drainage facilities or other facilities in connection therewith or for the common use of occupants of buildings within the subdivision unless and until:
(1) 
A plat of such subdivision is caused to be made in accordance with the regulations set forth herein and in §§ 5.01 through 5.07 of Article 66B of the Annotated Code of Maryland, as amended;
(2) 
Approval is secured thereof from the Planning and Zoning Commission as provided herein; and
(3) 
Said Commission has caused copies of said plat to be recorded in the office of the clerk of the court.
B. 
No plat of any subdivision shall be recorded until it shall have been submitted to and approved by the Planning and Zoning Commission as provided herein.
No land in a subdivision created after the adoption of these regulations shall be transferred, sold or offered for sale, nor shall a building permit be issued for a structure thereon, until a final plat of such subdivision shall have been recorded in accordance with these regulations and the provisions of the state and until the municipal improvements required in connection with the subdivision have either been constructed or guaranteed as hereinafter provided.
No building depending upon public water and sewerage or other utilities shall be permitted to be occupied before such facilities are fully provided and operational.
A. 
Any person who violates these regulations shall be subject to the penalties prescribed in § 5.05 of Article 66B of the Annotated Code of Maryland, as amended.
B. 
It shall be unlawful to locate, erect, construct, reconstruct, enlarge, change, maintain or use any building or land in violation of any regulation or provision of this chapter, or any amendment or supplement thereto, or fail to comply with any reasonable requirements or conditions imposed by the Board of Appeals.
C. 
Any person, firm or corporation violating any regulation or provision of this chapter or any amendment or supplement thereto shall be deemed guilty of a municipal infraction and, upon conviction thereof, shall be subject to a penalty as provided in Chapter 1, General Provisions, § 1-8 of this Code.[1]
