As used in this article, the following terms shall have the meanings indicated:
DOMESTIC ANIMAL
Includes those animals which are tame by nature, or from time immemorial have been accustomed to the association of man, or by his or her industry, have been subjected to his or her will, and have no disposition to escape his or her dominion, and for the purposes of this article, animals hereinafter described as farm animals shall be excepted from this designation.
FARM ANIMAL
Those domesticated animals which have historically been used in, by or for the production of agricultural income or products and which are generally assumed by prevailing community standards to be associated with farm or agricultural uses. Farm animals shall refer to sheep, chickens, roosters, goats, swine, horses, cows or animals of like or similar nature.
FARMS
Any parcels of land five acres or more in area.
PERSON
An individual, firm, partnership, corporation, voluntary association or an incorporated association.
PLACE
Any farm, plot, lot or other premise, house, garage, barn or other building of any kind whatsoever.
WILD ANIMAL
Includes those animals wild by nature, which because of habitat, mode of life or natural instinct, are incapable of being completely domesticated, and require the exercise of art, force or skill to keep them in subjection.
It shall be unlawful for any person to own, harbor, keep or maintain any pigeons, sheep, fowl, horse, cattle, goat, swine, poultry or other domestic, farm or wild animal, excepting dogs and cats, within the limits of the Township of Delanco except in conformity to the rules and regulations hereinafter established.
A. 
All persons subject to the regulations contained in this article must provide suitable animal housing which is completely enclosed and of a nature similar to a barn, stable, coop or corral.
B. 
At its closest point, such housing shall be at least 100 feet from the doors or windows of any structure located on adjacent property and at least 50 feet from any adjacent property line.
C. 
Such housing shall be kept clean at all times to prevent the creation of offensive odors, the accumulation of manure and the accumulation of organic refuse.
D. 
Such housing shall be kept in good repair, properly ventilated, waterproof and free from rats and other vermin.
E. 
Such housing shall be constructed in such a manner and of such material to be capable at all times of keeping said animals from running at large.
F. 
Said animal or animals regulated under the provisions of this article shall remain confined if left unattended within said housing. The owners of animals which are found running at large shall be guilty, upon proof, of a violation of the provisions of this article.
G. 
All manure or offensive organic refuse shall be kept or stored at least 100 feet from the nearest structure on any adjacent properties in a manner approved by the Health Office or Board of Health so as not to create a nuisance or health hazard.
H. 
The animals regulated under the provisions of this article shall not be maintained at a location or in a condition which permits the admission of animal noises such as crowing, bleating or other sounds of sufficient quantity or volume to be discernible beyond the property line of the property upon which the animals are located or housed.
A. 
Farm animals.

(1) 
Farm animals as herein defined shall be kept on a farm as herein defined.
(2) 
Farm animals shall not be permitted to be owned or maintained anywhere other than in accord with Subsection A(1) above within the Township of Delanco.
(3) 
Any person that desires to keep a farm animal other than on a farm in accord with Subsection A(1) above shall be required to seek a use variance before the Delanco Township Joint Land Use Board from the prohibited uses specified under § 110-8C(22).
(4) 
The provisions of Article V below create an exception to the above provisions with regard to the keeping of hens in accord with that article.

B. 
Wild animals.

(1) 
The keeping of wild animals is prohibited by N.J.S.A. 23:4-50 and 23:4-63.3, and this article is not intended to, and shall not be read to, conflict with those state statutes.

Any person who shall violate any provision of this article shall, upon conviction, be punishable as provided in Chapter 1, General Provisions, Article II, General Penalty. Each day that a violation continues shall be deemed a separate offense.
Any person who violates any provision of this article shall be deemed to be maintaining a public nuisance abatable by way of injunction in addition to any penalties provided for under § 123-5 above.
