[Derived from Ch. V, Sec. 5-1 and 5-2, of the 1978 Code]
As used in this article, the following terms shall have the meanings indicated:
DOG
Any dog, bitch or spayed bitch.
DOG OF LICENSING AGE
Any dog which has attained the age of seven months or which possesses a set of permanent teeth.
KENNEL
Any establishment wherein or whereon the business of boarding or selling dogs or breeding dogs for sale is carried on, except a pet shop.
OWNER
When applied to the proprietorship of a dog, includes every person having a right of property in such dog and every person who has such dog in his keeping, or harbors the same.
PET SHOP
Any room or group of rooms, cage or exhibition pen, not part of a kennel, wherein dogs for sale are kept or displayed.
POUND
An establishment for the confinement of dogs seized either under the provisions of this article or otherwise.
SHELTER
Any establishment where dogs are received, housed or distributed without charge.
The following regulations are hereby established for keeping dogs in the borough pursuant to the provisions of Chapter 151 of the Public Laws of 1941 of the State of New Jersey.[1]
A. 
Any person who shall own, keep or harbor a dog of licensing age shall annually, in the month of January, apply for and procure from the Secretary of the Board of Health of the borough a license and official metal registration tag for each such dog so owned, kept or harbored and shall place upon such dog a collar or harness with the registration tag securely fastened thereto.
B. 
The annual fee to be paid by the owner of any dog for its license shall be $3.50 and also the sum of $0.50 for the registration tag of each dog; and for each annual renewal the fee for the license and for the registration tag shall be the same as for the original license and tag; and the licenses, registration tags and renewals thereof shall expire on January 31 in each year.
C. 
License forms and uniform official metal registration tags designed by the State Department of Health shall be issued and shall be numbered serially and shall bear the year of issuance and the name of the Borough of Fort Lee.
D. 
The owner of any newly acquired dog of licensing age or of any dog which attains the licensing age, as in the Act provided, shall make application for a license and registration tag for such dog within 10 days after such acquisition or age attainment. The application shall contain the information as in the Act required.
E. 
The Secretary of the Board of Health shall forward to the State Department of Health each month, on forms furnished by the State Department, the information contained in the application.
F. 
Registration numbers shall be issued in the order of the applications.
G. 
Any person who keeps or operates or proposes to establish a kennel, pet shop, shelter or a pound shall apply to the Secretary of the Board of Health for a license entitling him to keep or operate such establishment. Such application shall describe the premises where the establishment is located or is proposed to be located, the purpose or purposes for which it is to be maintained, and shall be accompanied by the written approval of the local municipal and health authorities of the borough, showing compliance with the local and state regulations governing the location of and sanitation of such establishment.

A. 
All licenses issued for a kennel, pet shop, shelter or a pound shall state the purpose for which the establishment is maintained and all such licenses shall expire on January 31 of each year and be subject to revocation on recommendations of the State Department of Health or the local Board of Health for failure to comply with the rules and regulations of the State Department of Health or the local Board of Health of the borough after the owner has been afforded a hearing by either the State Department or the local Board.
B. 
The annual license fee for a kennel providing accommodations for dogs shall be $20. The annual license fee for a pet shop shall be $20. No fee shall be charged for a shelter or pound.
License fees collected or received under the provisions of this chapter, except registration tag fees, shall be received and disposed of in the manner provided in the Act.
The Chief of Police of the borough or any member of the Police Department, or such other person appointed for the purpose by the borough or by the local Board of Health of the borough, shall annually, in February, cause a canvass to be made of all dogs owned, kept or harbored within the limits of the borough and shall cause a report of the result thereof to be filed with the Secretary of the local Board of Health and the State Department of Health in the manner and form required by the Act.
The Police Department of the borough or such other person under contract, or otherwise, designated by the borough or by the local Board of Health shall cause the provisions of c., P.L. 1941,[1] to be enforced as therein provided.

The Chief of Police of the borough or any member of the Police Department or the designated agent of any humane society or such other person appointed for the purpose by the borough or by the local Board of Health of the borough shall take into custody and impound and thereafter destroy or dispose of, as provided in the statute:
A. 
Any dog off the premises of the owner which the official, person or agents have reason to believe is a stray dog.
B. 
Any dog off the premises of the owner without a current registration tag on his collar.
C. 
Any female dog in season off the premises of the owner.
All rules and regulations promulgated by the State Department of Health, shall be enforced by the local Board of Health or its designated agent. The provisions of this article or of the statute herein referred to shall be enforced by the local Board of Health or its designated agent or agents, or by the Police Department or any member thereof, or by the designated agent of any humane society under contract with the borough or with the local Board of Health or any such other person designated by the Mayor and Council of the borough by resolution duly adopted.
Any person who violates any provisions of this article or who fails or refuses to comply with the provisions of the statute herein referred to or any rules and regulations promulgated by the State Department of Health, pursuant to said statute, shall be liable to a penalty of not less than $5 nor more than $50 for each offense in the discretion of the Municipal Judge. A person who refuses or neglects to pay a fine imposed hereunder and costs incident thereto may be committed to the county jail for a period not exceeding 10 days in the case of a first conviction, and in the case of a conviction for a second, subsequent or continuing violation, for a period not exceeding 30 days in the discretion of the Municipal Judge.
