A.
There is hereby established in Franklin Township, Hunterdon
County, a state uniform construction codes enforcing agency to be known as
the "enforcing agency," consisting of a Construction Code Official, Building
Subcode Official, Plumbing Subcode Official, Electrical Subcode Official,
Fire Protection Subcode Official and such other subcode officials for such
additional subcodes as the Commissioner of the Department of Community Affairs,
State of New Jersey, shall hereafter adopt as part of the State Uniform Construction
Code. The Construction Code Official shall be the chief administrator of the
enforcing agency. The Township Committee may from time to time by resolution
designate the organization of and lines of authority between such officials
and other personnel.
B.
Each official position created in Subsection A hereof shall be filled by a person qualified for such position pursuant to P.L. 1975, c. 217 (N.J.S.A. 52:27D-119 et seq.), as amended, and N.J.A.C. 5:23, provided that in lieu of any particular subcode official, an on-site inspection agency may be retained by contract pursuant to N.J.A.C. 5:23. More than one such official position may be held by the same person, provided that such person is qualified pursuant to P.L. 1975, c. 217, and N.J.A.C. 5:23 to hold each such position.
C.
The public shall have the right to do business with the
enforcing agency at one office location, except for emergencies and unforeseen
or unavoidable circumstances.
D.
All fees established by this chapter shall be rounded
to the nearest dollar by the enforcing agency when the total fee due has been
calculated.
E.
The creation of the enforcing agency shall not alter,
change, repeal or otherwise modify the authority previously granted (or to
be granted in the future) to an individual to enforce any part of the Code
of the Township of Franklin or the laws of the State of New Jersey, through
the adoption of an ordinance.

The fees for a construction permit shall be as shown on Schedule A in Chapter 182, Fees, and shall be paid in their entirety before any permit is issued. (Please note that Schedule A will be changed from time to time by ordinance or state statutes. Be sure to reference the most recent ordinance regarding construction fees.)
The Construction Official shall, with the advice of the subcode officials,
prepare and submit to the Township Committee biannually a report recommending
a fee schedule based on the operating expenses of the agency and any other
expenses of the municipality fairly attributable to the enforcement of the
state uniform construction codes.
To provide for the training, certification and technical support programs
required by the Uniform Construction Code (UCC) Act [N.J.A.C. 5:23-4.19(b)]
and the regulations promulgated thereunder, a fee of $0.00265 per cubic foot
of volume of new construction and, additions shall be collected. The fee for
all other construction shall be $1.35 per $1,000 of value of construction.
Fees may be adjusted per revisions of the UCC. Remittance of the fee by the
enforcing agency to the State of New Jersey, Department of Community Affairs,
shall be made in accordance with the applicable statutes and the applicable
regulations promulgated thereunder.
The fee for plan review prior to issuance of a construction permit shall
be 20% of the construction permit fee, paid at the time of the application,
and shall be nonrefundable. This fee shall be deducted from the total cost
of the construction permit.

The fees for variation applications shall be as provided in Chapter 182, Fees.
The fee for the fire subcode shall be as provided in Chapter 182, Fees.

Fees for sprinkler systems shall be as shown in Chapter 182, Fees, on Schedule B. (Please note that Schedule B will be changed from time to time by ordinance. Be sure to reference the most recent ordinance regarding sprinkler system fees.)
Fire limits will be established as required by N.J.A.C. 5:23 by resolution
of the Township Committee, if necessary, on or before July 1, 1977, after
report by the Construction Code Official and subcode officials. The Construction
Code Official shall prepare and submit to the Township Committee biannually
a report reevaluating the delineation of the fire limits. This report shall
indicate the recommendations of the Construction Code Official regarding those
areas which should be designated as within fire limits, with the reasons therefor.
