As used in this chapter, the following terms shall have the meanings
indicated:
Includes any device upon which one or more persons may ride propelled
wholly or in part by human muscular power and having two or more tandem wheels.
No person residing in the Borough shall operate a bicycle upon any public
street or other public place within the Borough unless such bicycle has been
registered with the Police Department, as evidenced by a license tag or plate,
which tag or plate shall be attached to such bicycle.
No person engaged in the business of renting bicycles for hire in the
Borough shall rent or offer for rent any bicycle which has not been registered
and which does not have attached thereto a valid license plate or tag pursuant
to the provisions of this chapter.
Applications for registration of bicycle and license plates, or for
transfers thereof, shall be made to the Police Department upon a form approved
by the Mayor and Council and shall be accompanied by the prescribed registration
fee and proof of ownership. Such application shall set forth the name and
address of the owner, a description of the bicycle, the name of the manufacturer,
and the serial number appearing on the frame of the bicycle.
A.
Prior to the issuance of a license plate, the bicycle
shall be examined by a member of the Police Department to determine that the
bicycle is mechanically safe. In addition, if the inspection discloses that
the frame of the bicycle does not indicate a serial number thereon, the inspector
shall stamp a distinctive number on the frame.
B.
If the application for license and registration states
correctly the required information and the bicycle is in a safe mechanical
condition, the said license and registration tag or plate shall be issued
and forwarded to the Borough Clerk for his approval and signature.

A fee of $1 for two years shall be paid for each license. No license
or plate or tag shall be issued unless the registration fee has been paid.
All licenses shall expire on March 31 of odd-numbered years.
The license plate or tag shall be firmly attached to the frame of the
bicycle in such a position as to be plainly visible.
Each person who sells, transfers ownership of, or permanently dismantles
or destroys any bicycle registered pursuant to the provisions of this chapter,
shall make a report thereof, and shall surrender the license and registration
plate or tag to the Police Department within 10 days thereafter.

When the owner of a registered bicycle surrenders the registration plate or tag and license pursuant to the provisions of § 62-8 he may, upon application, obtain a transfer of same to another bicycle, provided he complies with the applicable provisions of the chapter for registration and inspection. A transfer fee of $1 shall be paid.
No person shall willfully or maliciously remove, destroy, mutilate or
alter the registration plate or tag or serial number on the frame of any bicycle
registered pursuant to this chapter.
A.
A bicycle used on the street at night shall have at least
one light, in working order, on its front. The lamp shall show a light and
be of such a nature and so displayed that it may be seen at least 200 feet
distant in the direction toward which the bicycle or similar vehicle is proceeding.
If the front lamp is so arranged that it will show a red light visible for
a distance of at least 200 feet in the rear thereof, no red light attached
to the rear of the bicycle or similar vehicle shall be necessary, but where
the front lamp does not show a red light, there shall be attached to the rear
of the bicycle or similar vehicle one lighted lamp showing a red light visible
for a distance of at least 200 feet from the rear thereof, this lamp to be
attached thereto and kept lighted from 1/2 hour after sunset to 1/2 hour before
sunrise.
B.
All bicycles shall be equipped with an audible signal
which can be readily heard at a distance of 200 feet.
C.
No person shall ride a bicycle on the sidewalks of the
Borough so as to endanger the orderly passage of pedestrian thoroughfare.
D.
No person operating a bicycle shall hold on to or hitch
on to an automobile or other vehicle.
E.
Every person riding a bicycle shall give the right-of-way
to a fire engine, police vehicle, and ambulance.
F.
Every person riding a bicycle upon a street shall be
granted all of the rights and shall be subjected to all of the duties applicable
to the driver of a vehicle by Chapter 4 of Title 39 of the Revised Statutes
of New Jersey and all supplements thereto, except as to those provisions thereof
which by their nature can have no application.

Any person over 18 year of age who violates any provisions of this article
shall, upon conviction thereof, be punished by a fine not exceeding $1,250,
a term of imprisonment not exceeding 90 days or a period of community service
not exceeding 90 days, or any combination thereof.
Failure of person under 18 years of age to comply with any of the provision
of this chapter may subject them to the authority having jurisdiction over
juvenile offenders.
