No person shall change the grading or drainage pattern of any property
in such a manner as to affect the grading or drainage of any adjacent or other
property or cause a standing water condition on the subject property or any
other property.
No person shall remove or cause to be removed, or deposit or cause to
be deposited any soil or earth from or on any lot or parcel in the Borough
of Garwood, and no person shall move or relocate any soil or earth on any
lot or parcel of land in the Borough of Garwood without having first applied
for and obtained a permit from the Borough Engineer for such purpose, provided,
however, that where less than one cubic yard of soil or earth is involved,
no permit shall be required.
Applications for permits under this chapter shall be as follows:
A.
All applications shall be in writing in the form prescribed
by the Borough Engineer and submitted to such official.
B.
The application shall state the quantity of soil or earth
to be removed, deposited or relocated, as the case may be, and the location
to which or from which it is to be deposited or removed.
C.
If applicable, the application shall set forth in detail
the route over which the soil or earth is to be transported within the Borough
of Garwood.
D.
The application shall include a sketch of the property
indicating all proposed changes and quantities.
E.
The Borough Engineer may require such additional information
as he, in his discretion, deems necessary to properly review and determine
the application, including, but not limited to, submission of a topographical
survey of the property, showing all existing and proposed grades.
Each application shall be accompanied by an application fee. There shall
be no additional permit fee. The application fee shall be:
Any person violating any provision of this chapter shall, upon conviction,
be subject to a fine not to exceed $1,000 or imprisonment for a term not to
exceed 90 days, or both. Each day during which or on which a violation occurs
or continues shall be deemed a separate offense.
