No ashes, garbage, rubbish, refuse or other
substances shall be dumped or deposited upon any lot or any place
within the limits of the Borough of Garwood except such place as may
be designated and approved in writing by the Mayor and Council.

A.
The Department of Public Works shall not remove garbage,
swill or offal from the following classes of premises:
B.
Service provided by the municipality with respect
to solid waste shall be limited to curbside collection along public
streets or roads which have been dedicated to and accepted by the
municipality. The Department of Public Works shall not enter upon
private property to remove solid waste from dumpsters or other containers.
C.
The owner, agent, lessee, tenant or occupant of every
premises where solid waste accumulates and which does not receive
municipal solid waste service shall make suitable arrangements for
the removal and lawful disposal of all solid waste from such premises
at least twice per week. The Board of Health or the Borough Health
Officer may require more frequent collections where necessary to preserve
the public health. If the Board of Health or Health Officer shall
so require, the owner, agent, lessee, tenant or occupant shall comply.

A.
All garbage, swill or offal which shall accumulate
in the Borough of Garwood, or which is stored, kept, or retained therein
shall be kept in watertight receptacles provided with tightly fitted
covers. Said receptacles shall be kept clean and no water shall be
allowed to enter therein except for the purpose of cleaning. No ashes
or rubbish shall be placed in the same receptacle containing garbage,
swill or offal.
B.
The owner, agent, lessee, tenant, or occupant of every
dwelling or other premises where refuse accumulates shall provide
and keep on such premises sufficient and suitable receptacles with
tight-fitting covers. Said receptacles are not to exceed thirty-five-gallon
capacity. Watertight metal or plastic cans are acceptable. No waste
may be stored or disposed of in plastic bags or in any other manner
than as specified in this article. Overloading and spillage of waste
is not permitted. All receptacles shall be equipped with handles to
facilitate handling. Receptacles that are badly broken or rotted may
be classified as refuse and collected and disposed of by the Street
Department. Receptacles or refuse shall not be set out at the curbline
for collection except during the hours of the day or days scheduled
for collection of refuse no earlier than 6:00 p.m. of the evening
before. Empty receptacles are to be removed from the curbline by no
later than 6:00 p.m. of the collection day.

D.
Except for municipal service, no refuse or junk will
be removed from any hotel, tavern, factory, restaurant, fast-food
stores, stores, residences or any other premises before the hour of
7:00 a.m. or after the hour of 6:00 p.m. on any day of the week.

For the purpose of these regulations, acceptable
refuse shall be considered only the accumulations from the ordinary
conduct of household or business operations generated in the Borough
of Garwood.

A.
Materials that may be deemed dangerous or injurious
to the health and welfare of the residents of the Borough of Garwood
or the agents, servants, and/or employees of the municipality, such
as poisons, acids, caustics, explosives, other hazardous wastes, soil,
large rocks, boulders, broken concrete, or hot or warm ashes, are
not acceptable for collection.
B.
Materials required by this chapter to be separated
from residential or nonresidential solid waste for recycling or other
purposes are not acceptable for collection.
C.
Building materials and building debris are not acceptable
for collection and shall be otherwise lawfully disposed of by the
property owner or resident as the case may be. The terms "building
materials" and "building debris" shall include, but not be limited
to, concrete, cement, plaster, stones and cinderblocks, drywall materials,
fencing, plaster, wood, aggregate, brick, siding, insulation, pipe,
plumbing fixtures, and any other materials used in construction or
which are accumulated from excavating, construction, building, demolishing
or repairing any structure. In any prosecution under this section,
the presence of any such materials or debris on or about any premises
shall be presumed to have accumulated from excavation, construction,
building, demolition or repairs on the premises.
D.
Any material not defined as “municipal waste”
under the statutes and regulations of the State of New Jersey and
the Union County Solid Waste Plan, as amended from time to time, are
not acceptable for collection.
Collection shall be as follows:
A.
South side of the Borough: Monday and Thursdays (except
Willow Avenue, New Street, Myrtle Avenue, off New Street).

The following regulations shall pertain to bulk
waste, as defined herein:
A.
BULK WASTE
WHITE GOODS
Definitions. As used in this section, the following
terms shall have the meanings indicated:
Household items other than household garbage, such as furniture,
furnishings and household equipment permitted by law to be disposed
of.
Household appliances such as clothes washing machines, clothes
dryers, stoves, refrigerators, air conditioners, water softeners and
microwave ovens.
B.
Collection.
(1)
Bulk waste shall be collected on a schedule
adopted by the Mayor and Council by resolution. Other regulations
may be adopted by resolution. No bulk waste shall be set out at any
time or in any manner other than as set forth in said regulations.
(2)
No white goods shall be set out for collection
with bulk waste or at any other time, except by appointment made with
the Department of Public Works.
C.
Residential Bulk Waste Program. The fee for participation in the Residential Bulk Waste Program is established at $55 per permit for the disposal of 750 pounds of bulk waste. "Bulk waste" means household items other than household garbage, such as furniture, furnishings and household equipment permitted by law to be disposed of and in accordance with the regulations contained in Chapter 99 of the Code of the Borough of Garwood. Subsequent annual fees shall be established by resolution of Council.

No person shall bring, cart, remove, transport
or collect any garbage, ashes, trash, bulk waste, recyclables, or
any other solid waste whatsoever from outside the Borough into the
Borough for the purpose of dumping or otherwise disposing of same.
No truck or other vehicle containing any garbage, ashes, trash, bulk
waste, recyclables, or any other solid waste whatsoever which has
been transported into the Borough shall be parked or allowed to remain
standing on any street in the Borough or on any public property for
a period in excess of two hours.
