An article to establish a yard waste collection and disposal program in the Borough of Garwood, so as to protect public health, safety and welfare, and to prescribe penalties for the failure to comply.
For the purpose of this article, the following terms, phrases, words and their derivations shall have the meanings stated herein unless their use in the text of this article clearly demonstrates a different meaning. When not inconsistent with the context, words used in the present tense include the future, words used in the plural number include the singular number, and words used in the singular number include the plural number. The word "shall" is always mandatory and not merely directory.
CONTAINERIZED
The placement of yard waste in a trash can, bucket, bag or other vessel, such as to prevent the yard waste from spilling or blowing out into the street and coming into contact with stormwater.
PERSON
Any individual, corporation, company, partnership, firm, association, or political subdivision of this state subject to municipal jurisdiction.
STREET
Any street, avenue, boulevard, road, parkway, viaduct, drive, or other way, which is an existing state, county, or municipal roadway, and includes the land between the street lines, whether improved or unimproved, and may comprise pavement, shoulders, gutters, curbs, sidewalks, parking areas, and other areas within the street lines.
YARD WASTE
Leaves, grass, brush and other household vegetative waste.

Yard waste may be disposed of only as follows:
A. 
Leaves. No person shall sweep, rake, blow or otherwise place loose leaves at the curb or along the street at any time. No person shall dispose of leaves except in accordance with this section. All leaves for disposal shall be bagged in biodegradable leaf bags (not plastic) or placed in containers not to exceed 32 gallons. No bagged or containerized leaves may be placed at the curb or along the street more than seven days prior to a scheduled and announced collection. Bagged leaves shall not be placed closer than 10 feet from any storm drain inlet. Placement of such leaves at the curb or along the street at any other time or in any other manner is a violation of this article. If such placement of leaves occurs, the party responsible for the placement of the leaves must remove the leaves from the street, and said party shall be deemed in violation of this article and shall be subject to the penalties provided in this article.

B. 
Grass and brush. No person shall place grass or brush at the curb or along the street at any time other than after 6:00 p.m. on the evening prior to a scheduled and announced collection. Brush and grass will be picked up at curbside when notice of such is provided by the Borough of Garwood. Brush must be cut to a maximum length of four feet and shall be bundled in bundles of no more than 50 pounds or containerized as per regulations for grass. Grass must be placed in covered trash receptacles of no more than thirty-five gallon-capacity or in biodegradable bags. Such receptacles or bags may not exceed 50 pounds. Placement of such grass or brush at the curb or along the street at any other time or in any other manner is a violation of this article. If such placement of grass or brush occurs, the party responsible for the placement of the grass or brush must remove the grass or brush from the street and said party shall be deemed in violation of this article.
The provisions of this article shall be enforced by the Police Department, Department of Public Works and Board of Health of the Borough of Garwood.
