[HISTORY: Adopted by the Township Committee of the Township of Kingwood 11-21-1988 by Ord. No. 6-14-88. Amendments noted where applicable.]
As used in this chapter, the following terms shall have the meanings indicated:
GARBAGE
Putrescible animal and vegetable waste resulting from the handling, preparation, cooking and consumption of food.
LITTER
Garbage, refuse and rubbish, as defined herein, and all other waste material which, if thrown or deposited as herein prohibited, tends to create a danger to public health, safety and welfare.
PRIVATE PREMISES
Any dwelling house, building or other structure designed or used, either wholly or in part, for private residential purposes, whether uninhabited or temporarily or continuously inhabited or vacant, and shall include but not be limited to any yard, grounds, walk, driveway, porch, steps, vestibule or mailbox belonging or appurtenant to such dwelling, house, building or other structure.
PUBLIC PLACE
All streets, sidewalks, boulevards, alleys, beaches or other public ways and all public parks, squares, spaces, docks, grounds and buildings.
REFUSE
All putrescible and nonputrescible solid waste (except body wastes), including but not limited to garbage, rubbish, ashes, street cleanings, dead animals, abandoned automobiles and solid market and industrial waste.
RUBBISH
Nonputrescible (not likely to grow rotten) solid wastes consisting of both combustible and noncombustible wastes, such as paper, wrappings, cigarettes, cardboard, tin cans, yard clippings, leaves, wood, glass, bedding, crockery, vehicles or vehicle parts, rubber tires, appliances, furniture and similar materials.
VEHICLE
Every device in, upon or by which any person or property is or may be transported or drawn upon a highway, including devices used exclusively on stationary rails or tracks.
A. 
No person shall sweep, throw, deposit or dump litter in or upon any property, whether occupied, open or vacant, with or without improvements, and whether owned by that person or by someone else, or in a public place or pond, lake or stream or other body of water within the Township, except in public receptacles or in authorized private receptacles for collection.
B. 
No person shall throw or drop any bundle, object, article, litter or debris of any nature from a vehicle, whether in motion or not, when such vehicle is on a Township road or any other public highway in the Township.
C. 
No person shall throw, place, deposit, discharge or drop any bundle, object, article or debris of any nature on any Township road, right-of-way, easement or on any other publicly owned land, except when acting under the authority of the Township Committee.
Persons placing litter in public receptacles or in authorized private receptacles shall do so in a manner which prevents the litter from being carried or deposited by the elements upon a public place or upon private property.
No person shall permit, allow or maintain litter in or on any of his property, whether improved or vacant land and whether owned or leased in the Township, and such person shall not permit open or overflowing waste disposal bins or containers on his/her property.
For violation of any of the provisions of this chapter on either public or private property, complaints may be filed by either citizens, police officers or the Board of Health of Kingwood Township.

No person will be permitted to sweep into or deposit in any gutter, street, catch basin or other public place any accumulation of litter from any public or private sidewalk or driveway. Every person who owns or occupies property must keep the sidewalk in front of his or her premises free of litter. All litter sweepings must be collected and properly containerized for disposal.

It is unlawful for any residential or commercial property owner to permit open or overflowing waste disposal bins on his or her property.

It is unlawful for any vehicle to be driven, moved, stopped or parked on any public roadway unless such a vehicle is constructed, covered or loaded to prevent its load from dropping, sifting, leaking or otherwise escaping therefrom. Any person operating a vehicle from which any materials which constitute litter have fallen or escaped which could cause an obstruction, damage a vehicle or otherwise endanger travelers or public property must immediately cause the public property to be cleaned of all such materials and must pay the costs therefor.

It is unlawful for any owner, agent or contractor in charge of a construction or demolition site to permit the accumulation of litter before, during or immediately following completion of any construction or demolition project. It is the duty of the owner, agent and contractor in charge of a construction site to furnish containers adequate to accommodate flyable or nonflyable debris or trash at areas convenient to construction areas and to maintain and empty the receptacles in such a manner and with such a frequency as to prevent spillage of refuse.

It is unlawful for any person to place, to cause to be placed or to hire another person to place any advertisement, handbill or unsolicited material of any kind in or on any street, sidewalk, building or vehicle within the Township of Kingwood in such a manner that it may be removed by natural forces.

Any person, firm or corporation violating any of the provisions of this chapter shall, upon conviction thereof, be subject to the penalty provisions in Chapter 1, General Provisions, Article II, General Penalties, of the Township Code.
