It shall hereafter be unlawful for any person or persons, partnership or corporation to keep or harbor swine within the limits of the Township of Evesham, other than as hereinafter provided in §
140-3 hereof, unless permission therefor shall first be had and obtained from the Township Council for that purpose.
No permission, as hereinbefore provided, shall
be issued for the keeping of swine within the Township of Evesham
until and unless a public hearing on any application is first had
upon due notice published at the expense of the applicant in a newspaper
circulating in Evesham Township once a week for two consecutive weeks,
giving notice to the residents of the Township of Evesham of the time
and place where the application will be considered by the Township
Council of the Township of Evesham.
A. At the conclusion of said public hearing, the Township
Council of the Township of Evesham shall first determine by a majority
vote of its membership that the granting of permission to the applicant
to keep swine for the location applied for will not constitute a nuisance
to the neighborhood in general.
B. Upon determination aforesaid, the Township Council shall direct the Township Clerk to issue a written permit for the calendar year, for which the applicant shall pay to the Township the fee provided in Chapter
72, Fees, of this Code. The granting of such permission to the applicant shall vest the right in the applicant to maintain swine for the location for which permission is granted during the current calendar year only, and shall be subject strictly to all state requirements and local Department of Health requirements as to sanitation so as to safeguard the health and welfare of the surrounding community.

C. Thereafter, annual permission shall be given to the applicant upon the annual payment of the fee provided in Chapter
72, Fees; provided, however, that no written complaint is received by the Township Council from any adjoining residents as to the maintenance of said swine, and, if complaint is received, a new hearing shall be had in accordance with the provisions of this chapter to determine whether or not the renewal permit shall be issued.

The provisions of this chapter shall not apply
to the keeping or maintaining of 10 or less swine by anyone within
the limits of the Township of Evesham; provided, however, that said
swine are maintained in a sanitary manner so as not to endanger the
health or welfare of adjoining neighbors. Otherwise, the keeping of
said swine contrary to sanitary conditions and the welfare of the
neighborhood shall be considered a violation of this chapter.

Any person, partnership or corporation violating any provision of this chapter shall, upon conviction, be punishable as provided in Chapter
1, General Provisions, Article
I, of this Code.
