A.
Required. It is unlawful for any person to conduct the
business of or act as an itinerant or door-to-door peddler or salesman of
goods, wares or merchandise, either by sample or otherwise, in Wicomico County
unless he has secured and holds a current license as such, issued upon application
by the Sheriff of Wicomico County.
B.
Applications; issue. The Sheriff shall prepare and have
available application forms for a peddler's license, containing such
provisions and information as, in the opinion of the Sheriff, may be necessary
to keep a proper and complete listing of the persons in Wicomico County who
are engaged in this occupation from time to time. The license shall be issued
upon application at a cost of $25 for each year; and the cost shall not be
prorated for portions of a year. The license year begins as of January 1.
C.
License to be carried. All licenses shall be carried
by the licensee, and said license shall be exhibited to any officer or citizen
upon his request.
D.
Exceptions. Nothing in this section shall be construed
or used to apply to any person who is going from door to door in any activity
or enterprise which is conducted for and on behalf of any nonprofit, charitable
or eleemosynary agency or organization or to any person who is going from
door to door in the sale of farm produce or seafood of any kind, which he
has produced or taken.
E.
Penalty provisions. Any person who violates any provision
of this section is guilty of a misdemeanor and shall be subject, upon conviction
thereof, to a fine not to exceed $25 for each violation.
