The following regulations are hereby adopted:
A. 
No trespassing on the Town-owned land around said pond will be allowed. This includes, but is not limited to, hiking, camping, picnicking, horseback riding or use of any off-highway recreational vehicles at any time.
B. 
No boating, fishing, swimming or any other use is allowed on or in the pond.
C. 
The Board of Selectmen may grant special permission to enter this Town-owned land.

The Town of Wolfeboro adopts this article under its authority to regulate public water systems under RSA 38:26.
The purpose of this article is to ensure the use of water is regulated in a manner the Board of Selectmen deems to be in the best interest of the Town of Wolfeboro. The Board of Selectmen may use reasonable means to protect, preserve and maintain the public health, safety and welfare whenever it has determined there exists a water supply shortage.
As used in this article, the following terms shall have the meanings indicated:
PERSON
Any individual, corporation, trust, partnership, joint-stock company, association, state, municipality, commission, United States government or any agency thereof, political subdivision of the state or any interstate body, or other entity.
WATER SUPPLY SHORTAGE
That situation when insufficient water is available to meet the present or anticipated needs of the municipality. A water supply shortage usually occurs due to drought or a major infrastructure failure.
Upon declaration of a water supply shortage or other water emergency by the majority of the Board of Selectmen, the Board of Selectmen shall be authorized and empowered to impose such restrictions necessary to conserve and maintain adequate reserves of the public water supply, including any or all of the following:
A. 
Restricting landscape and lawn watering and irrigation to designated days.
B. 
Landscape irrigation shall be prohibited, except for irrigation by low volume devices only, of crops for use as food by residents at a primary residence.
C. 
Use of automated landscape sprinkler systems is prohibited.
D. 
Prohibiting all outdoor water use.
E. 
The filling of swimming pools is prohibited.
F. 
Washing or cleaning streets, driveways, sidewalks or other impervious areas is prohibited.
G. 
Washing of cars and boats at a noncommercial facility shall be restricted to days as described in Subsection A above.
H. 
Washing of cars or boats at a noncommercial facility shall be prohibited.
The use of water for firefighting, health, sanitation, medical purposes and other essential uses shall not be restricted. However, domestic water use conservation practices should be implemented wherever possible.
Notification of a declaration of water supply shortage, and of the specific restrictions to be imposed, shall be posted by the Board of Selectmen in at least two conspicuous public locations and published in a newspaper of general circulation within the Town of Wolfeboro. Said notification shall include the specific restrictions imposed and the effective date thereof.
The Board of Selectmen of the Town of Wolfeboro, upon determination that a water supply shortage no longer exists or that the restrictions in place should be amended, may terminate or amend the imposed restrictions. Public notification of any such termination or amendment should be given in accordance with § 167-8.
Notwithstanding the authority granted by § 167-6 of this article, any order imposing restrictions in the use of water shall not apply to any person obtaining water from sources other than the public water supply, unless it can be clearly shown that the use of such water directly affects the public water supply. Written notice restricting the use of such water shall be given to the person in control of the same, and may be effective forthwith.
The Wolfeboro Police Department shall investigate alleged violators of this article and shall issue the appropriate citation.
Any person failing to comply with the restrictions imposed pursuant to this article shall be subject to a fine of $100 for the first offense, $200 for the second offense, $500 for each consecutive offense after the second offense and subject to imposition of civil penalties pursuant to RSA 38:26, II, not to exceed $10,000 per day of such violation. Recovered penalties shall inure to the Town for such uses as the Board of Selectmen may direct.
Upon a determination that a person has violated the restrictions of a declaration of water supply shortage, the Board of Selectmen may discontinue the furnishing of water to such person. Such discontinuance shall remain in effect until the Board of Selectmen determines in its discretion that any substantial risk of further violations has ceased.
