Commercial uses and retail uses shall not conduct, operate or do business earlier than 6:00 a.m. nor later than 11:00 p.m. on any day. For the purpose of this chapter, commercial uses or retail uses may continue to conduct, operate, and/or do business after 11:00 p.m. regarding only those customers who were present within the establishment in question on or before 11:00 p.m., so that those customers' business may be completed.
All deliveries and/or pickups (including trash) shall occur no earlier than 6:00 a.m. nor later than 11:00 p.m. on any day. This restriction applies to all retail uses, commercial uses and office uses.
The delivery and pickup of newspapers, magazines, periodicals and other such reading materials are exempt from the restrictions of these provisions.
The Director of Public Safety has the authority to waive or modify the restrictions as recited herein for specific days of the week, for specific hours, for specific dates, for specific events, for a long period of time or a short period of time, utilizing the Standards for Waiver as recited herein.
The Director of Public Safety shall consider the following in granting a waiver or modification of the restrictions as provided herein:
A. 
The hardship of the restrictions herein may cause a commercial business, retail business, office use, an event, festival, etc.
B. 
The noise, traffic, and/or number of individuals involved in the activity which is the subject of the waiver.
C. 
Objections by individuals that may be affected by the waiver.
D. 
Recommendation and/or requirement of the Planning Board or Zoning Board of Adjustments in an application before the Planning Board or Zoning Board of Adjustments.
E. 
The location of the commercial, business or office property to which the waiver would apply.
Violations of this chapter shall be punishable as provided in Chapter 1, General Provisions, § 1-14.
