The officers of the Haledon Volunteer Fire Department shall consist of a Chief of the Department, one First Assistant Chief, one Second Assistant Chief, two Captains, two First Lieutenants and two Second Lieutenants, one from each fire company, unless otherwise provided for in §
23-8 of this article.

A. Department Chief.
(1) The Department Chief shall be appointed by the Mayor upon advice
and consent of the Council.
(2) In order to qualify to hold the office of Department Chief, a candidate
must have been an active member for a period of at least five years
in the Haledon Volunteer Fire Department, including at least one year
as a firefighter, one year as Lieutenant, one year as a Captain and
one year as Assistant Chief. A candidate must also have completed
Firefighter 1, NJ Hazmat Emergency Response Level 1 Operational and
Incident Command.
(3) The term of the Department Chief shall be for a period of one year,
expiring December 31 of the year in which he or she was appointed.
(4) In the event of a vacancy during a term, for any cause whatsoever
during a specified term, the office shall be filled by the First Assistant
Chief for the unexpired term thereof until the Mayor makes an appointment
to fill the vacancy upon advice and consent of the Council.
B. Assistant Chief.
(1) There shall be two Assistant Chiefs, designated as First Assistant
Chief and Second Assistant Chief.
(2) The First Assistant Chief shall be elected by the members of the
house of which the Department Chief is a member. If there are no qualified
members in the house of which the Department Chief is a member, a
member of the other house may be nominated and elected by the house
of which the Department Chief is a member to the office of the First
Assistant Chief.
(3) The Second Assistant Chief shall be elected by the members of the
house of which the Department Chief is not a member.
(4) In order to qualify to hold the office of Assistant Chief, a candidate
must have been a firefighter for one year, Captain for one year, Lieutenant
for one year and have completed Firefighter 1, NJ Hazmat Emergency
Response Level 1 Operational and Incident Command.
(5) The term of Assistant Chiefs shall be three years.
(6) In the event of a vacancy during a term, the house of which the vacating
Assistant Chief was a member shall be responsible for electing a candidate
to fill the unexpired term of office.
C. Captains and Lieutenants.
(1) Each of the companies of the Haledon Fire Department shall elect
from its own active members in good standing one Captain, one First
Lieutenant and one Second Lieutenant.

(2) Any member in good standing who has had one year as a firefighter,
one year as a Lieutenant and has completed Firefighter 1, NJ Hazmat
Emergency Response Level Awareness, NJ Hazmat Emergency Response Level
1 Operational and Incident Command is eligible for Captain.
(3) Any member in good standing who has had one year as a firefighter
and has completed Firefighter 1, Incident Command and NJ Hazmat Emergency
Response Level 1 Awareness is eligible for Lieutenant.
(4) Captains and Lieutenants shall be elected for one-year terms.
D. Election procedures.
(1) Each fire company shall adopt election procedures to ensure that
any elections held pursuant to this section are conducted fairly and
without bias.
(2) Annual elections must be held on or prior to the third Monday in
the month of November.
(3) Election results must be submitted to the Municipal Clerk by December
1 following the annual election or within 10 days following a special
election.
(4) All election results for the positions of Assistant Chief, Captain and Lieutenant shall be considered for confirmation or rejection by the Council of the Borough of Haledon in accordance with §
23-9 of this chapter.
(5) A successful candidate must submit an affidavit attesting to his
or her qualifications to hold the office to which he or she was elected.
