A. 
Whenever a new site plan is submitted to the Planning Board or the Board of Adjustment for review and approval, it shall be the responsibility of the Administrative Assistant to the Planning Board and the Board of Adjustment, acting on behalf of either Board, to submit the site plan to the appropriate Fire Chief in either the Cedar Knolls or Whippany Fire Departments.
B. 
Following receipt of the site plan, the Fire Chief or his designee shall return a marked-up plan depicting the recommended fire lanes and/or fire zones which are necessary to ensure the safety of the public, and to provide for the proper access of police, fire or first-aid apparatus in the event of an emergency. Letters of recommendation from the Fire Chief and Police Chief shall also be submitted explaining the reasons for the particular designation. If a designation is not required at the time, the Fire Chief and Police Chief will confirm this in writing to the Planning Board. Copies of the marked-up plan and letters of recommendation shall be submitted to the Planning Board or Board of Adjustment within 30 calendar days.
C. 
Following the designation of the approved fire lanes and/or fire zones by the Planning Board or Board of Adjustment and as fully shown on the approved site plan, it shall be the responsibility of the property owner, at his/her expense, to install the necessary signage and pavement markings, all in conformance with the approved site plan. The property owner shall comply with the signage and pavement marking standards governing the designation of fire lanes and/or fire zones as set forth in § 137-30. Upon approval, the property owner shall forward to the respective fire district a certified site plan showing the location of all signage and pavement markings.
A. 
To ensure that fire apparatus has adequate ingress and egress around existing structures which are not properly designated for fire lanes and/or fire zones, the Fire Chief or his designee may recommend to the Planning Board the designation of fire lanes and/or fire zones. Such recommendations shall also have the concurrence of the Chief of Police. All requests to the Planning Board will be in writing. In addition, a marked-up copy of an existing site plan will be provided to the Planning Board depicting the proposed fire lane and/or fire zone designations.
B. 
To expedite all requests in a timely fashion, the Planning Board will conduct its review of submissions within 30 calendar days following the receipt of a recommendation(s).
C. 
Any proposal to designate areas of an existing property for new fire lanes and/or fire zones shall not reduce or limit the number of parking spaces or loading zones which would otherwise modify the site to the extent of imposing a hardship on the owner of the property and/or operator of a business located on the parcel in question. All decisions related to the creation of fire lanes and/or fire zones on a new or existing private properties shall rest with the Township's Planning Board.
D. 
Following the review and approval by the Planning Board of the proposed fire lanes and/or fire zones, as depicted on the revised site plan, the Fire Chief shall notify the property owner, in writing, or by hand delivering such written notice, specifically describing the area designated, the reason for making the designation and the responsibility of the property owner to install signage and pavement markings in accordance with the Township's standards described in § 137-30. All expenses related to the installation of signage and pavement markings will be paid by the property owner. The installation of markings shall be made by the property owner no later than 45 calendar days following notification by the Fire Chief or designee.
E. 
The property owner may be subject to penalties prescribed under § 137-33 for failure to either properly erect signage and/or install pavement markings or in completing the installation of signs and pavement markings within the 45 calendar days.
All fire lanes and/or fire zone designations shall be marked as follows:
A. 
Signage. In accordance with the current Manual on Uniform Traffic Control Devices, "NO STOPPING OR STANDING" signs shall be erected which designate a fire lane or fire zone.
B. 
Pavement markings. All painted line delineations shall be four inches in width and shall be applied in accordance with the current Manual or Uniform Traffic Control Devices. The wording shall read "FIRE LANE" and shall also comply with the requirements of the Current Manual on Uniform Traffic Control Devices.
C. 
Maintenance. All designated fire lane signs or markings shall be maintained in a clean and legible condition at all times and replaced when necessary to ensure adequate visibility. This shall be done at the property owner's expense.
D. 
At any time when a designated fire lane is removed due to repaving or resurfacing, the respective fire district will be notified. Upon completion of the work, the existing fire lane designations shall be reestablished in accordance with an approved site plan.
Pursuant to N.J.S.A. 40:48-2.46 and N.J.A.C. 5:70-3.1(a)3, F-311.2, the Police Department and the Chiefs of the Cedar Knolls and Whippany Fire Departments and/or their designees are authorized to issue summonses for any violation of any designated fire lane and/or fire zone.
A. 
Any person, firm, corporation or partnership or other entity violating any provisions of this article, or failing to comply therewith, or who shall violate or fail to comply with any order made thereunder, or who shall build in violation of any detailed statement of specification or plans submitted and approved thereunder, or any certificate or permit issued thereunder, or who shall fail to comply with such an order as affirmed or modified by the Township Committee, or by a court of competent jurisdiction, within the time fixed herein, shall severally, for each and every such violation and noncompliance respectively, be subject to the penalty provisions as stated in N.J.A.C. 5:70-2.12 et al. Each and every day a violation occurs shall be deemed a separate and distinct offense. The respective fire district shall receive all moneys to the fine imposed, except for court costs.
B. 
The application of the above penalty shall not be held to prevent the enforced removal of prohibited conditions.
