The head of the Division of Building Inspections shall be the Construction Official who shall be appointed by the Township Council and shall have the qualifications required by law.

The Construction Official shall:
A. 
Enforce the building code and have all the powers, functions and duties prescribed by general law and ordinance for construction officials.
B. 
Issue building permits and certificates of occupancy.
C. 
Keep a record of his or her proceedings and a permit book and complaint book, all of which shall be subject to inspection. He or she shall report monthly to the Township Council the number of permits issued, the estimated cost of such work and the fees received and paid by him or her to the Treasurer.
D. 
Have the powers and duties prescribed by the Township Council by ordinance or resolution.
The Code Enforcement Officer shall be the head of the Division of Code Enforcement and he or she shall have such assistance as the Township Council from time to time appoints.
A. 
Duties. It shall be the duty and responsibility of the Code Enforcement Officer and his or her assistants to administer a comprehensive system of code enforcement with respect to the following codes of the Township:
(1) 
Zoning Ordinance.
(2) 
Subdivision Ordinance.
(3) 
Housing Code.
(4) 
Soil Removal Ordinance.
(5) 
Quarry Ordinance.
(6) 
Taxicabs.
(7) 
Junk dealers.
(8) 
Coin-operated amusement devices.
(9) 
Charitable solicitations.
(10) 
Peddlers, hawkers and vendors.
(11) 
Abandoned motor vehicles.
B. 
It shall be the duty and responsibility of the Code Enforcement Officer and his or her assistants to annually make a survey of at least 1/5 of the area of the Township of Hardyston for the purpose of determining the existence of violations of any of the ordinances mentioned in Subsection A of this section to issue appropriate violation notices and to take all other appropriate steps including the institution of suits or complaints in the municipal court or other courts of the State of New Jersey, to abate or enjoin the continued violation of any such ordinance.
C. 
Any complaints relating to the alleged violation of any of the ordinances enumerated in Subsection A of this section shall be referred immediately by the official or employee receiving such complaint to the Code Enforcement Officer. The Code Enforcement Officer shall keep a record of all complaints received and of all actions taken to abate any violation or prosecute same and shall submit a report monthly to the Township Council of such actions. The Code Enforcement Officer shall also submit an annual report to the Township Council on or before December 31 of each year reporting upon the activities of his or her office during the year.
D. 
The Code Enforcement Officer shall also be the Zoning Officer and perform all the duties of the Zoning Officer as required by statute and ordinance.
The head of the Division of Land Use Administration shall be the Land Use Administrator who shall be appointed by the Township Manager and shall have general knowledge of the workings of the Planning Boards and Zoning Boards.
A. 
Receive all applications for development, determine whether such applications are complete as required by the Township ordinance, notify applicants whether submissions are complete or incomplete, solely for the purpose of placing the application on the calendar, within the time provided by law;
B. 
Establish the calendar of cases for the meetings of the Planning Board and Zoning Board of Adjustment;
C. 
Notify the applicants of the dates upon which matters will be heard in sufficient time so that notices can be given within the time required by N.J.S.A. 40:55D-12;
D. 
Provide for the making of a verbatim record of all proceedings before each Board;
E. 
Be responsible for giving notice by advertising or otherwise, in accordance with statutory authority, of all public notices required to be given by the board pursuant to the Municipal Land Use Law or by the Open Public Meetings;[1]

F. 
Maintain and have general charge and control of all records of the Planning Board and Zoning Board of Adjustment, take minutes of meetings and take care of the correspondence of said Boards.
G. 
In addition, at the discretion of the Township Manager, the Land Use Administrator may serve as Grants Administrator for the Township.

Any complaints relating to any alleged violation of the Subdivision, Site Plan Review or Zoning Ordinances[1] of the municipality shall be referred immediately to the Land Use Administrator who shall keep a record of all complaints received and all actions taken to abate any violations and immediately notify the proper board or official of said complaint.

A. 
Definitions. As used in this section, the following terms shall have the meanings indicated:
ADMINISTRATIVE AGENT
The entity responsible for administering the affordability controls of some or all units in the affordable housing program for Hardyston Township to ensure that the restricted units under administration are affirmatively marketed and sold or rented, as applicable, only to low- and moderate-income households.
MUNICIPAL HOUSING LIAISON
The employee charged by the governing body with the responsibility for oversight and administration of the affordable housing program for Hardyston Township.
B. 
Establishment of position; compensation; powers and duties.
(1) 
Establishment of position of Municipal Housing Liaison. There is hereby established the position of Municipal Housing Liaison for Hardyston Township.
(2) 
Subject to the approval of the Council on Affordable Housing (COAH), the Municipal Housing Liaison shall be appointed by the governing body and may be a full- or part-time municipal employee.
(3) 
The Municipal Housing Liaison shall be responsible for oversight and administration of the affordable housing program for Hardyston Township, including the following responsibilities which may not be contracted out:
(a) 
Serving as Hardyston Township's primary point of contact for all inquiries from the state, affordable housing providers, administrative agents, and interested households;
(b) 
Monitoring the status of all restricted units in Hardyston Township's Fair Share Plan;
(c) 
Compiling, verifying and submitting annual reports as required by COAH;
(d) 
Coordinating meetings with affordable housing providers and administrative agents, as applicable;
(e) 
Attending continuing education opportunities on affordability controls, compliance monitoring, and affirmative marketing as offered or approved by COAH;
(f) 
If applicable, serving as the administrative agent for some or all of the restricted units in Hardyston Township as described below.
(4) 
Subject to approval by COAH, Hardyston Township may contract with or authorize a consultant, authority, government or any agency charged by the governing body, which entity shall have the responsibility of administering the affordable housing program of Hardyston Township. If Hardyston Township contracts with another entity to administer all or any part of the affordable housing program, including the affordability controls and affirmative marketing plan, the Municipal Housing Liaison shall supervise the contracting administrative agent.
(5) 
Compensation. Compensation shall be fixed by the governing body at the time of the appointment of the Municipal Housing Liaison.
(6) 
Administrative powers and duties assigned to the Municipal Housing Liaison.
