A. 
The intent of this chapter is to establish a detailed plan for the use of land and buildings in the Township of Hardyston, based upon the Township master plan and any amendments thereto and other studies and findings, enacted in order to promote and protect the public health, safety, morals, comfort, convenience and the general welfare of the people.
B. 
After the adoption of this chapter, no use or structure shall be permitted in the Township which is not listed as a permitted, accessory or conditional use or unless permitted by the Board of Adjustment.

For the purpose of this chapter, the Township of Hardyston is hereby divided into districts or zones, to be designated as follows:
MIDD-10 Minimum Impact Development District 10
MIDD-5 Minimum Impact Development District 5
MIDD-3 Minimum Impact Development District 3
G-C Golf Course
SGU Open Space/Government Use
R-3 Single-Family, Lakeside Residential
R-4 Medium Density Residential District
R-5 Attached Single-Family/Multifamily Residential District
R-C Residential Commercial District
C-R Commercial Recreation District
B-1 Neighborhood Business District
B-2 Highway Business Service District
TC-SCD Town Center Shopping Center District
I-1 Light Industrial District
I-2 Medium Industrial District
I-3 Industrial/Quarry District

The location and boundaries of the above districts are hereby established on the Zone Map of the Township of Hardyston in Sussex County, dated August 28, 2019 (prepared by Carrine Piccolo-Kaufer, AICP, P.P.), which is attached hereto and made a part of this section. Copies of the map are on file in the office of Township Clerk and are available for inspection.[1]

A. 
Unless otherwise noted, the district boundary lines are intended generally to follow the center lines of streets; the center lines of railroad rights-of-way; existing lot lines; the center lines of rivers, streams and other waterways; and municipal boundary lines. However, where a district boundary line does not follow such a line, its position shall be shown on the zoning map by a specific dimension expressing its distance in feet from a street line or other boundary line as indicated.
B. 
In the event a district boundary line divides one or more lots, then the zone boundary line shall be considered the lot limit for computing all area, bulk, yard, buffer and any other dimension requirements specified in this section, unless a zone district boundary line falls within 20 feet of any part of a lot line existing at the time of passage of this chapter, then the lot line shall be considered the zone boundary line.
C. 
In cases of uncertainty or disagreement as to the true location of any district boundary line, the determination shall be made by the Board of Adjustment after a hearing on notice to all entitled to same.
