[HISTORY: Adopted by the Township Committee

This chapter shall be known as the "Industrial
Commission Ordinance of the Township of Holland."
There is hereby established and created a local
Industrial Commission to be known as the "Industrial Commission of
the Township of Holland."
A.
The Industrial Commission of the Township of Holland
shall consist of seven members.
B.
The members of the Commission shall be appointed by
the Township Committee.

C.
Each member shall be, for the last five years preceding
his appointment, a citizen of the United States and a qualified voter
of the State of New Jersey. Each member shall have had experience
in industry or commerce and shall be conversant with the industrial
needs and facilities of the Township of Holland. No more than four
members shall be from the same political party, and none shall be
a Township Committee member.

D.
There shall be appointed to the Commission, unless
local conditions shall otherwise require, the following representatives:
(1)
A representative of industry and commerce.

A representative of labor.
(3)
A representative of a bank located in the Township
of Holland.
(4)
A representative of the Chamber of Commerce active
in the Township of Holland.
(5)
A representative of the service clubs active in the
Township of Holland.
(6)
A representative of the legal profession.
(7)
A representative of a recognized real estate dealers'
association.
E.
The members and officers of the Commission shall serve
without compensation, but each shall receive his actual disbursements
for his expenses in performing his duties.
F.
Of the original members appointed to the Commission,
one member shall be appointed for one year, one member for two years,
one member for three years, two members for four years and two members
for five years. At the expiration of each of the above terms, the
new member or members shall be appointed for a term of five years.
Vacancies in the membership of the Commission, occurring for whatever
cause, shall be filled by appointment by the Township Committee for
the unexpired term of the vacant position. Members shall serve for
their respective terms and until their successors are appointed and
qualify.

G.
Any member of the Commission after a public hearing,
if he requests one, may be removed by the governing body for cause.
"Cause" shall be deemed to include, but not be limited to, absence
by a member, without reasonable excuse and prior notice thereof to
the Chairman, from three consecutive regular or special meetings,
or absence, without reasonable excuse and prior notice thereof to
the Chairman, from three regular or special meetings within any six-month
period.

A.
The members of the Commission shall annually choose
from among the members a Chairman and such other officers as they
may deem necessary. The Mayor of the Township of Holland shall be
an ex officio member of the Commission, but shall have no voting privileges.

B.
A majority of the members shall constitute a quorum.
C.
The Commission may adopt rules and regulations for
the administration of the provisions of this chapter. All such rules
and regulations shall be subject to the requirements of state law.
A.
Insofar as may be practicable, the employees and assistants
required by the Commission shall be recruited from the public officers
and employees of the Township. The Municipal Counsel shall be the
counsel to the Commission; the Municipal Engineer shall be the engineer
of the Commission; and the several departments of the municipal government
shall be available to the Commission for the purposes of the Commission's
business. Municipal employees serving the Commission shall do so without
compensation other than their regular compensation as employees of
the municipality. The Commission shall, from time to time, make known
to the Mayor its wants in the nature of services by employees of the
municipality, and the Mayor shall designate which of the municipality's
employees, if any, shall render such services.
B.
To the extent that the Commission shall deem it necessary
to carry on its function, and to the extent that it shall consider
the services of existing employees of the municipality insufficient
for its purposes, it may employ such additional employees or services
and at such compensation as may be approved by resolution of the Township
Committee. Its requirements in this direction shall be submitted from
time to time in writing to the Township Committee.
C.
The Commission shall have and maintain a suitable
office where its maps, plans, documents, records and accounts shall
be kept, subject to public inspection at such times and under such
reasonable regulations as the Commission shall determine. If practicable,
existing office facilities of the Township shall be used without charge
by the Township, and the office and similar equipment of the municipality
shall, wherever possible, be used by and be made available for the
use of the Commission without charge.
To effectuate its purposes, the Commission shall
have the following powers:
The Commission is created to pursue, perform
and exercise all those purposes, functions and powers authorized by
N.J.S.A. 40:55B-1 to 40:55B-10, inclusive, subject to the limitations
therein set forth.
The Commission shall make an annual report to
the Township Committee, setting forth in detail its operations and
transactions for the preceding 12 months.
