Upon the installation of street improvements by a developer and prior to the acceptance by the Township as provided in § 255-68A(3)(a) and (b) and (16) of the Land Development Code of the Township of Independence, the developer shall be responsible for the maintenance of said streets, including but not limited to maintaining the streets free of snow and ice.
In the opinion of the Street Commissioner or his designee,
if a developer has not kept any streets in his control free and clear
of ice and snow within a reasonable time after any storm, then the
Township shall be authorized to plow or treat said streets for snow
and ice, and such plowing or treatment shall not be considered an
acceptance of the roadways.
If the Township shall plow or treat the snow and ice,
the developer shall pay, per event, to the Township fees which are
hereby established at the rate of $0.25 per running foot of street
for the plowing and $0.25 per running foot of street for each application
of salt and/or sand, which fee shall be paid by the developer within
10 days of the submission of a statement to the developer, or in the
absence thereof, said amount to be credited against its escrow account.[1]
